Default California Lemon Law for 05 350Z

Hey guys:

Just wanted to get your opinion on this. I have a brand new 2005 350Z in Oct of 2004. The car is only 5 months old with 8,000 miles. Well, to make a long story short. Last week while driving 70 mph on the freeway the engine shut down completely. The next day I took the car in to the dealer for repairs, It turns out that it was a bad crank position sensor that causes the engine to shut down while driving. Well today I was driving home on the freeway, and the same thing happened again, the engine shut down again. So I immediately took the car back to the dealer for repairs. But whats weird is that this time the check engine light did not come on. So the service manager decided to hook up a diagnostic computer to the car, it turns out that I had another bad crank position sensor for the second time. Do you guys think I have a good Lemon Law case against Nissan. Please help

I know that in Florida, Lemon Law applies after the attempt to fix it 4 times (I believe that's what it is).

Look up exactly what the Lemon Laws are for California, then you should be able to make a better decision.

Revision to the California Lemon Law states:

Recently Senate Bill 1718 was signed by Governor Gray Davis.

This bill alters Lemon Law protections for new vehicle owners and small businesses. It modifies Lemon Law coverage by reducing the number of failed repair attempts from four to two on defects likely to cause death or serious bodily injury before a vehicle is considered a lemon. It also expands Lemon Law protection to those vehicles with a manufacturer's weight rating of less than 10,000 pounds that are bought or used primarily for business.

Is it likely to cause death or serious injury? Thats the legal wrangling you'll have to deal with.

If the engine dies he loses power steering.

If he is going 70 mph and he suddenly loses power steering its gonna be one hell of a ride.

Driving a car w/o power steering while moving is only slightly more difficult than with it. I know because I've been there and done that. However, its when your starting from a complete stop that it presents an issue. Going 70mph on a highway would be fast enough to get over onto a shoulder hopefully w/o an issue.

My point was that the fault has to be proven to be dangerous to his life to be considered covered under the quoted lemon law. If he had a decent lawyer, I'm sure he could pull it off.

yea, been there twice, but i think its from the popchrager i have. but i kno how to control it now so it wont die, i juss blip the throttle and give it more gas so the a/f doesnt go all crazy.

The back pressure from my exhaust causes my engine to dip below idle and sputter every now and then but the computer always pulls it back up quickly.

I think that the fact the engine turns off is a serious deal. What if it starts doing it on roads not just highways. I think there are alot of possibilities where this can cause an accident. It will not be hard to prove.
ON the other hand lets say your cup holder kept braking, or a button on the radio. That is where the lemon law does not apply.
I would say one more time and approach them that you will be filing for a lemon law and they just might give you a new one.

Thats kinda ghetto though broh. I bet your thinking that popcharger and its resulting headaches for you wasnt worth the scant 5 rwhp?

More details. Do you have any mods? Did you have the cruise control on? Were you in 6th gear? Did you punch the accelaerator when it died? Did you put in the clutch when it died?
