California Lemon Law for 05 350Z
Hey guys:
Just wanted to get your opinion on this. I have a brand new 2005 350Z in Oct of 2004. The car is only 5 months old with 8,000 miles. Well, to make a long story short. Last week while driving 70 mph on the freeway the engine shut down completely. The next day I took the car in to the dealer for repairs, It turns out that it was a bad crank position sensor that causes the engine to shut down while driving. Well today I was driving home on the freeway, and the same thing happened again, the engine shut down again. So I immediately took the car back to the dealer for repairs. But whats weird is that this time the check engine light did not come on. So the service manager decided to hook up a diagnostic computer to the car, it turns out that I had another bad crank position sensor for the second time. Do you guys think I have a good Lemon Law case against Nissan. Please help

I know that in Florida, Lemon Law applies after the attempt to fix it 4 times (I believe that's what it is).

This bill alters Lemon Law protections for new vehicle owners and small businesses. It modifies Lemon Law coverage by reducing the number of failed repair attempts from four to two on defects likely to cause death or serious bodily injury before a vehicle is considered a lemon. It also expands Lemon Law protection to those vehicles with a manufacturer's weight rating of less than 10,000 pounds that are bought or used primarily for business.

My point was that the fault has to be proven to be dangerous to his life to be considered covered under the quoted lemon law. If he had a decent lawyer, I'm sure he could pull it off.
yea, been there twice, but i think its from the popchrager i have. but i kno how to control it now so it wont die, i juss blip the throttle and give it more gas so the a/f doesnt go all crazy.

The back pressure from my exhaust causes my engine to dip below idle and sputter every now and then but the computer always pulls it back up quickly.

To be safe, I would have the dealer try to fix the issue at least 2 more attempts. That what I had to do per my attorney's advice. READ MY SIG.

I think that the fact the engine turns off is a serious deal. What if it starts doing it on roads not just highways. I think there are alot of possibilities where this can cause an accident. It will not be hard to prove.
ON the other hand lets say your cup holder kept braking, or a button on the radio. That is where the lemon law does not apply.
I would say one more time and approach them that you will be filing for a lemon law and they just might give you a new one.
