Default Seeking Legal Advice

So, there's major roadwork construction going on on my street. The construction workers basically tore out the asphalt, so now the street is like a feet deeper than it was. To get in and out of my apartment and into the streets, the construction workers built a small ramp out of asphalt. This ramp is is not long enough for the Z. My car scratches everytime I drive out of the street. It's not just that plastic guard thing that scratches. My rear bumper gets hit everytime, and there's two noticeable scratches on the bumper. I think it's unfair that the ramps are designed only for higher-clearance cars to get in and out of the street. My car cannot go through without getting scratched. So I called the city engineer, and he told me basically he can't do anything about it and told me that I could file a claim with the city attorney if I wanted. Is it a good idea to file a claim in this situation? Is my case strong? Will it be worth it to file a claim? Is there anything I can do to get someone to pay for the damage?

Any real help would be appreciated. Thanks

You can file a claim with the city, but it will cost you more to fight them on this than it would to pay your deductible and have it fixed. Remember the city has attorneys on retention and so they can drag it on forever. I only say this because I went through a battle with the city and it was the biggest pain and even though I was right, it was not worth the headaches. Just my 0.2 worth.

My car's not lowered, and I can't zig zag down to avoid scratching. No matter what angle you go down, it will scratch.

Build your own ramp . . . one of the members here carried a set of home-made ramps for such situations. I have a GMC pickup as a daily driver and I have built a ramp to get 4-wheelers up the bed of my truck. Most auto parts stores (Autozone, Pep Boys) sells the metal lip -- just add a 2x6 1-2 ft wooden plank. About $20 worth total.

If this is a public street I don't think you can lay it out flat. I heard you can pay someone to repave to make it over.
