Because he can sue them for Hot Pockets!

I almost won the lottery one time, should Texas pay me because I almost won and some guy in line behind me made me pick 6 wrong numbers?

OP: Was this a USED car or a NEW car? Sounds like a used car to me. If it is a used car I personally don't think you have much of a case, especially with things like the window motor out of warranty. As for the transmission lockup, you didn't get hurt and it's not a widespread, well known problem (in fact I've never heard of it happening before), so good luck with that one too. I personally think you're wasting your time if you seek legal counsel. You need to have evidence of a re-occuring problem (more than 3 times) that Nissan couldn't fix.
+1. In Plus Nissan sold the car just fine. So actually you wouldnt be suing Nissan it would be the dealership that did the fix. Good luck with it. But i dont see a bright future outta this one.

More power to ya.... If you make a big enough stink with the dealer and have lots of documents and such supporting your claim chances are they will be really nice and fix everything to make you go away. Then you can switch dealers and never have to mess with them again

Truthfully I've never bought a lottery ticket...

man take em' for all they have. i had the same problem a few mounths ago. they said that my clutch was messed up because of me. i have an 06 and after 7000 mi my clutch burnt out. and i wasn't raging on it. i called the corperation and still nothing happened. it was a big pain in the @$$. 3000+ FOR a new clutch. get'em pimp!!

you are in for a long battle, Nissan isn't going to budge, they don't want to set a precedent. Be prepared to spend a lot of money on lawyers and court fees, this may end up being a $125,000 Z ($35k for the Z, $90,000 fees). Good luck and keep us posted, I'll check back with ya in about 2 years.

The clutch went out and warranty didn't "cover"
My window (motor) went out. They didn't want to fix it cuz of warranty.
and my third gear is grinding still.....

Now you got 2 Z's with the same problems.

More reason to win this case

I have YET to see any post with miles on teh car posted or original purchase date that the car was bought new. There are a TON of variables with warranty.

I worked for a nissan dealership for a long time, in teh service dept. Its almost daily someone gets pissy b/c there car isn't covered under warranty. Your **** broke, you have 40k miles, deal with it. don't like the warranty, sell your car berfore it runs out, by an extended, go with a another manufactuer like Hyundai who has I think 10/100 basic warranty.

Clutch is covered 12/12k.... PERIOD. If you can manage to screw up a clutch that quickly, either get off the track or learn to drive. You can't expect Nissan to pay for your neglence (sp).

WIndow streak, yeah there is a TSB.... 3/36K coverage.... PERIOD. If they broke your **** while being serviced, take it up with the Manager....CALMLY!!! Never understood why people fly off the handle for a accident.

Believe it or not, as some of you may already know. If your car is BARELY past warranty limits there is some hope. Its called a Good Will Gesture. But know this....its not commonly used nor easy to come by. You HAVE to be a DAMN GOOD customer. I don't mean a oil change whenver conveniant, i mean doing your services there. Its has to be close to out of warranty specs., and if the dollar amount is super high, don't expect full coverage under that Good WIll. Its not uncommon for Nissan to 50/50 split a bill with the customer. but let me reiterate GOOD customer. They WILL look at your service history and take recomendations from the advisor/manager.

RICHY350Z - your talking about your clutch going out.... OK how about that 14 page thread about you racing every car. I wouldn't cover that **** either if i was the dealer, regardless of warranty. You can tell when ya pull a clutch down how badly its burnt.

YOu said they didn't want to fix your window, did they??

How many miles on your car? They look at your trans for the 3rd gear issue???

Nissan customer service is stupid i will never buy another nissan. They denied warranty on my car with 6k miles on it because a wrist pin came out of the rod.

That sounds like a warranty issue to me, don't take that crap from Nissan, you need to go up the line and get some satisfaction.

so dealer plugs into the ob port, or whatever that name for that port is, and reads the data....and goes..."hum, looks like said vehicle has been redlined 50% of the time......you the driver?" ...........this is for the folks that abuse, or track their rides and tries to play it off cool.......

to the op, .....document everything.....a little late now, but witnesses would 've helped.......g/l.

have you tried different dealer? May be that dealer is just f*cked you up. But good thing you didn't get into an accident.
