nissan service: should i take action?

i own an 03 m/t touring 350z. since i bought the car used (15,xxx miles) its had a 5th gear grind. turned to find out its a shot 5th gear synchro (i now hav 32,xxx miles) ive went to nissan several times complaing about this, and i even stated wut the problem was after a certified transmission specialist looked at it (ATD transmissions. nissan always responded w/ leave it here, well take a look. call me up, come down there and get the same old answer. "we couldnt find a problem" i tok the head manager 4 a spin. u c when it goes in relatively quick, it grinds. then they say well theres nothing we can do about it, as its a wearable item. it wears down? doesnt the whole car wear down over time? i think thats the powertrain warranty, which 3 year/36,000 miles. but they have records since winter of 05 b4 the 3 years was up. should i take action against them and file a complaint, and possibly get a new transmission? or should i accept the inevitable and buy a new tranny myself? any help would be greatly appreciated. thanks guys.

I went through nearly the same thing with the tire problem. Nissan finally agreed to correct this when they were under the threat of a class action suit.

My experience is you need to convince the person you are doing face-to-face. Going "upstairs" won't get you anywhere until you get your local Nissan dealer on your side. If this fails you contact the district manager/office and tell them you are going to court. If you are right and they have no defense, they cave-in quickly. I can't believe the effort I put into a battle with my dealer on the 2003 tire problem. As soon as the district manager realized I was serious and planning a settlement in small claims court, I got new tires.

5yr./60K mi. powertrain warrany. Have them fix it. Stop being a push-over. Tell them to replace it with the 009 tranny and replace the clutch at their expense while their in there. This is a known prob. call NNA.

i myself have an 03 aswell.....
and i have the same problem with 5th gear.....
they have told me the same exact thing .. their is nothing wrong with it ....
i talked to them about the powertrain warranty....
they were like .. if its a clutch issue .. we will not be able to fix it.

It's not a clutch issue. Search for the replaced tranny thread. I had mine replaced no questions asked.
I take it this problem was an issue with the 06 and below????

my bose system was cutting out.. took it to the dealership.. they said they couldn't 'find the problem'.. i said, you keep searching... 45 min later of me telling them it's there.. they finally stated that they 'found the problem'. they told me maybe 3 or 4 times nothing was wrong... but i didn't give in and kept telling them to look and then they finally admitted. just be more firm with them
