Unhappy Do I even have a chance here????

So heres the situation. I took the car to the dealer to have some axle work done. Appearantly all they did was lube the axle. Thats it according to them. Well, a few days after getting it back I went to apply the brakes and nothing happened. Also I noticed that the E Brake didnt hold the car like it did before I brought it in. So needless to say I crashed her. Nothing to bad but some definite body damage. $10,000 to be exact. So I guess thats bad enough. My question is do I even have a case here??? The body shop said they didnt notice anything wrong with the rear axle or brakes but suggested that I get a second opinion. The Ins. company suggested the same as well. I dont want millions of dollars or anything just them to pay for the repairs and claim fault......Thanks guys.....

Well unless you can PROVE they did something to the breaks I would say you don't have a case at all.

I would also say it will be harder to prove since it was a few days after you had work done that you wrecked it.

I would have someone else look at it to see but honestly I doubt there is much you are going to get out of them

Also, you will most likely have trouble getting a lawyer to deal with a 10k case unless there is personal injury involved.

Let me get this straight, you wrecked because your brakes did not work when you pressed the pedal down? Are the brakes functioning fine now? The fact that the shop you took it to said there didn't seem to be anything wrong with the brakes really hurts your case. No offense, but just reading what is here, it sounds like you messed up, wrecked your car, and want to pin it on the dealer somehow.

If you're telling the truth, the words "world's least lucky guy" come to mind.

However, brakes are not prone to stop working, and then suddenly start working again. Whether you're telling the truth or not, your story REEKS of B.S.

Not a prayer in hell.

The shop lubricates the rear axle and inadvertently disconnected all the brakes. And you crash the car. I am not falling for this tall tale and neither would any jury.

my friend also rear ended another car because he swears that for that instant his brakes didn't work. Of course afterwards he could never repeat it but swears till this day that the brakes didn't grab when he pressed on them. I trust my friend of course but if you can't repeat it afterwards you don't have a shot in hell of winning that money.

I knew this would be one of those things that is almost impossible to prove. To be honest here, this is no BS. It was one of those freak things that you can never duplicate when you need to. I dont know...... I guess I just have to decide if its worth the fight or not......

No, the only thing you have to decide is whether or not you want to waste a lot of time and money in fighting this case. I doubt you'll even find a lawyer who will want to take the case, unless you have better, SOLID evidence than presented here.

Skids come to mind. People think the brakes aren't working in a skid. They are. It's just the tire isn't grabbing anymore.

If you would have left the dealership, and on the first stop sign/light crashed because the brakes failed, yeah, you may have something. But this happened days later, so thats a negative, Ghost Rider.

Anyway, you may have a case if it was proven the brakes were faulty AFTER they messed with them.

Can you be a little more thorough in your story? Were the brakes fine until the time they didn't work at all? Was the pedal to the floor? Did you try pumping the brakes? Was there a line of fluid along the lines of you crashing?
