did they actually cash your deposit check? Is this legal? I mean a grand deposit to be on a list to place an order?

That sucks, but you might find someone on this forum giving up their spot, there was one here in MD. Even if it's out of state it can be shipped for like $500. Just a thought.

keep in mind that he ordered in june proven fact his dealer is a lying sack of S$%t still i mean cmonhe ordered in june and he ran out of patience?
what about you guys with the january orders?

I am only dignifying this with a response because I know there are others out there thinking the same thing. Im not so much pissed about the wait, I'm pissed because of the undue runaround, drama, and the fact that I'm not gonna be one of the first to have this car. I coulda waited since January with the knowledge that I was gonna be the first to be driving the Z, especially since my original plan was to have a local shop sponsor me (which I already had lined up). Now, unfortunately, my sponsorship is in jeapordy because the car wont have the 'hottness' it would have brand new. Should I choose to stick with my dealer, I wouldn't be receiving my car till early 2003 - at least. Not acceptable.

Also, Rahilio, see my reply in Fyi.

i understand you dewd 100% the problem is you didnt order in jan dealer suck **** that a giving fact and did you get screwed yes because you got lied to i belive the dealers fax in there second order in late august i suggest you get to another dealer asap and put your order in for dec maybe even nov any autonation will give you the z at msrp no hassle

also i read somewhere in this thread dealers had to fax in there preoder by april for june july build

If you really want the car, just wait it out.....

So you get it in end of November instead of the beginning of November....big deal!

You've already seen what's in the pre-order package.

Sure Nissan treats you like a troll if you are not in the pre-order program, but you WILL get a Z.

Maybe guilt your dealer into taking a few hundred off the price since they screwed up so royally....can't hurt trying.

I think both rahilio and abz are missing the point here.

Cheap is not complaining about waiting for his car, his complaint is that the sales person took his money and lied about what he did. Nothing was done. His vehicle is going to be ordered in Sep, not when he put down his money. That's why he's pissed and rightfully so.

local neighborhood dealer advice again...the best thing to do to really get at a dealer is to ruin his public image or to affect his supply. The best way to achieve this is to do two things. One contact nissan customer service AND the nissan regional office and tell them the whole story combine this with contacting the BBB and the local newspaper and news stations. The idea behind this is to create bad publicity for the dealership/to have nissan cut his allotment due to bad press. Now some of you may think that local news wouldnt care but believe me you'd be suprised how much people want to know what dealerships cannot be trusted. Try to find some more people the dealership has screwed. If you tell your dealership this is what you are gonna do if you are not satisfied with how this is handled then mayeb they will bend over to make amends with you. Can't hurt give it a try.

Sorry to hear what happened, dude.

Listen, you can also go to the JA and explore your options. It just might be possible to get the dealership on a banned business list for base personnel. Or the dealership just might do something for you with this threat on their business.

I was on the other site just now, post says this Redwood City dealership was just given 2 units on the first allocation. You might want to check it out.

I talked to the dude at Boardwalk Nissan in redwood city, and they do have the 2 cars available still. A little over MSRP, but not outrageously so. However, after much deliberation, I've decided to cancel my order and be responsible (damnit!). Im gonna take that $$ and probably buy a cheaper project car and start looking for a house to buy.

Zbarrister, thanks for breaking it down for those guys. I've been so damn frustrated with this and some other stuff the past few days I was just gonna end up flaming em if I got into it, so I was trying to avoid the situation.

I think Nizl helped me put everything in perspective the most. Perhaps in a year or two I'll get the convertible

Oh and by the way - I never did get to see any of the special stuff sent to preorderers. No CDROM, no Love, no Lust. Nada. Only thing I got was the brochure, which I picked up at the dealership and again at the Danville show. And with my dialup, most videos are off-limits too.

Hey Throb,

In Cheap's case, it looks like it's just a particular salesperson; not the whole dealership. At least I want to think that way since my preorder is from the SAME dealership.

So far, I've been satisfied. Got my confirmation on time/as expected. Received the Danville museum invitation from them and then got a follow up call from them asking if I've received the invite.

Last time I called, my salesperson was no longer there, but the manager referred me to new salesperson that was assigned my account. The salesperson told me my name was on his preliminary report for estimated delivery date. Told me I'd have my VIN shortly before the vehicle's arrival. He even called me after he came back from the San Diego product introduction to tell me he finally saw the Z in person and how excited he was about the Z.

So there; no complaints here.

Just some thoughts, though I am not an attourney, I think you should talk to one. You have beeen damaged financially and emotionally. You relied on information that was fraudulent. An attourney that takes your case on a contingent basis (no cost to you, split any settlement 50/50) will go after the dealer and also sue Nissan (deep pockets) because you relied on them to "keep you informed" and they did'nt. Thinking of the timing with the sales roll-out eminent, you should get some satisfaction.

I really hope this works out for you !

You won't have a case going after Nissan. They are not in the loop, just the dealership. Let's say if you can go after Nissan, their pocketbook would bankrupt you, that is after their team of lawyers eat you for breakfast.

Would I even have a case? I mean, it seems to me that if it came to court it would be my word vs. the dealerships (in regards as to what I should have expected concerning delivery and ordering). They just TOLD me that they were going to fax the order in, and they just TOLD me that I was 7 out of 10. And the person who TOLD me all of this no longer works at that dealership (Ryan Sutton). I'm not really seeing a case holding up in court here... as much as I wish there was. I think it was more a case of "lets screw the kid 'cause he won't know any better" or "there's no way that kid is really gonna be able to pay for a $30k car."

I'm also curious as to whether I was bumped down on the list post-ordering because I had an MSRP price, as opposed to the other 14 suckers on the list behind me and possibly the 9 (?) before me.

Any lawyers in the house? And of course ya'll will be my character witnesses, right? (especially those of you at Danville, except for Zbart cause he'd be in a conflicting situation.)

Same thing pretty much happened to me dude. I live in Houston, Tx and Mossy was pullin some of that crap w/me and several others. I ordered mid april w/ a "supposed" delivery in October, which later went to Nov/Dec which is now officially Jan/Feb. I was angry once....back when I cared....now i'm willing to just wait and meantime i'm just dreamin of buyin a bike to ease the pain.
