Yea. Insurance pays. Therefore premiums go up. You can leave the retarded insults out of this.

I said law-suits because it's no better than being an ambulance chaser. And insurance companies do take each other to court. My g/f's mom was represented by hers last year.

Here is what you do... right about now... your leg hurts... your back and your neck. then go to a doctor and a chiropractor and get a Perminent partial % (i think thats what its called ) and based on that plus them paying all your medical bills you will eventually settle and get money for it. Last accident that happned to me( i had 5% on my neck alone) 30 grand for future medical bills and compensation. the 30k did not include the totaled car i was in. So if you play this smart you will get a good amount of money. Plus i dont think you will be abusing the system at all since her dumb *** hit you and you could have died so i would go for the money including a new car.

Cover your *** now for the aches and pains that may arise down the road!!! Don't let insurance weasel out of anything.

Pick up a new Z... love the HR... and start modding again.

It's almost a good thing that it got hit twice and will be a total loss instead of a fix.... I personally would be more pissed to be driving in a vehicle that has been fixed from the body shop.

You said the cop agreed to be a witness for the second accident; so I'm assuming you have his phone number...... Call him up and thank him for saving your life by asking you to step away from the car and away from the road.... I'm sure he'll appreciate it.

Just sue her for pain and damages.

Last accident that was my fault (should have been 50/50 but no witness and it was a 18 yr vs 35 yr mother of 3, she was speeding and ran a light...) I got sued for the max amount of insurance had on me. How she was able to pull it off when she went to the doctor 3 weeks later and I was at the hospital within 40 mins of the accident ill never know. But sue, apparently its easy...

But be warned to work with the insurance first, they offered her 10k+ medical and repair. She walked away and got her self a TV lawyer. Well yes she did sue for more, but her medical bills where 60k (paid directly to the doctor only) and 2k for personal injury. Half of that went to the lawyer. So 1k for her self, she could have sued for less but got more

Found out what medical place she went to and its a chiropractic/spa... 15 sessions

But she was not injured at the accident and never went to a real doctor ever.

All total my bills for ER visit + specialist + rehab + random check from insurance (the felt sorry for me, and felt that I deserved something for being put through a dumb pointless lawsuit) + totaled car was only 8k

70k total between a 1996 ford contour(totaled), and a 1997 f150 (that didn’t total) in 2001.

So like I said, mention the word sue, and new figures will pop up normaly... If one can sue and not be injured or lose anything, one can sue for losing something. And I bet anything you hurt tomorrow. My accident was a t-bone as well.

I would say go get checked out, being in that big of an accident could have caused something bad. It may be prevention, but better safe than sorry.

I know it sounds dicked, but I would complain about pain and damages now just in case whatever the insurance cuts you is a lot less than the actual value (likely the case), and then back out on the pain and damages claim if you think the payment for the car alone is fine.

damn, damn thats all I have to say about the story, sorry about ur lose mang, I would be devestated if that happened to my Z, but you're correct with the insurance giving you the amount you car is worth, they will probly pay off ur lean first then give you whats left over, Id say go see a lawyer about this and see what they say that'll be the best way to go about it...and get yourself another Z man, forget about the corolla, when I read that I thought for a second that you got hit in the head too during the accident...LOL Best of luck, just glade to hear you came out of it

As we stood on the corner, I was giving the police my story of what happened. We both looked at the car together from a distance and he said at that speed, I am surprised you are alive. He goes back to check on the other people, and while I am looking at my car thinking, shes starting to die, easily 4-5k worth of work however she is saveable. I can still come out of this ok.

Not even 10 minutes later, 2 cops, 3 people all together on a corner see a FexEx truck drive right by us and SLAM SQUARE into back of my Z. Adding further salt to the wounds. This sent the Z propelling it 20 feet further, hitting the curb, jumping over the concrete curb, and watching my Z go up a side hill doing a 360 which landed between two trees. Now it was facing on coming trafficc and looking square at me. The cop and I looked at each other, and I asked him, please tell me that did not just happen? Please tell me I am dreaming....Any hopes of saving her were put to an end by a 3 ton FedEx truck. The rear was gone, the bar in the back was touching the roof on my car. The bumper was then sitting in the middle lane and winshield shattered into thousands of pieces. At this point, the level of damage was now labled totalled as it suffered two hits in different areas of the car. The police now had to write a 2nd report and I asked him to be my witness for this 2nd issue. He agreed and mentioned the FedEx driver was clearly at fault.

This happened about 7 hours ago. Since then, I've checked myself out at the hospital and everything, everyone is okay. I am at a loss of words. Drained both physically and mentally which finds me to type this story at 12:00AM due to a million thoughts running through my mind. The scene playing over and over in my head. I have the day off tomorrow to collect my thoughts and start this brutal process of getting a replacement vehicle...another Z? Or go with a Corolla (I cringe) with our great gas prices. I am at a complete loss of words about this situation. I'm 30 years old - a sensible driver yet my car seemed to be a magnet for getting into accidents that aren't my fault. If I wouldn't have had my seatbelt on then I probably wouldnt be typing this message. I thank God EVERYONE is alive and I also thank God that an angel was looking over me. I loved my Z to death and what a horrible way for it to go.

Not that I'm an expert, but I would imagine with the fact that TWO plaintiffs you SHOULD be able to receive sufficient monetary compensation to cover ALL of your expenses. In addition, I suggest you pursue your loss of the depreciated value, in other words you want compensation for the difference in value between what you receive and the Blue Book value of a comparable vehicle.

Sorry for your loss, just glad you have not suffered major physical injury.

Why is he wrong!!???? If someone has a valid claim - as does the OP - they have EVERY right to seek the MAXIMUM compensation due to them.

Let me ask....If you post an item for sale would you want the most you can get for that item???...or would you take less than what someone offered??? It's the same thing. If insurance offers him $40K total; should he decline because that is "too much"???

A valid claim is one thing but to fake an injury is something else. Look at the big picture here. Not only are you committing fraud but you are using and wasting resources (i.e. physicians, nurses, hospitals, chiropracters etc..) that could be helping other people that really need it.

I say get as much compensation (legally) for your car as possible and if you lost time away from work due to an injury, then try and get that back, but to fake or exaggerate an injury to get more money for your car is wrong. Insurance is not here to make money off of, it is there to make the person whole, i.e. to where they were 1 sec before the wreck.

And people wonder why insurance rates are high...

Make a claim against both insurance companies.... I'm sure FedEx has a pretty decent insurance coverage, and the other girl's should pay for the damage what she caused (hopefully you took pictures before the fedex truck hit)
