They are willing to buy back the car for the same price that they sold it to me and get me the car I originally wanted (shipped from a different dealer), but they're charging me $36,100 for a car that has an MSRP of $34,800. This was the same car that they quoted me for $32,500 a week ago. If I take out the extra I got for my original trade in, this mistake will end up costing me about $2200 (on top of paying the difference between the Base and Touring models). So my options with them are to either take this new deal or keep my car. I've talked to a lawyer about taking this to court and he told me that the case could go either way, and if I did do something like that I'll end up paying that much in legal fees anyway. So I've got some thinking to do, but none of my options seem that great to me right now.

That's complete ********. They are obviously to you and by you making the mistake and not realize it until afterwards they feel they have the upperhand. Don't let them slap you around, that's just nonsense $2200 over sticker?
Have you talked to them about taking this to court?
Try everything because it seems they're pulling the stubborn card. The salesman is just trying to cover his own *** in all of this.

You should tell them that they're *******s who will go as low as deceiving their customers into buying cars that don't have the right equipment and it states on the contract that in fact you are buying a Touring. If the contract you have isn't legal, then why the hell did they get you to sign it. Take a look at their company policy and call them out on it because it will most likely say some ******** like "We are committed to assuring customer satification, selling you the perfect car for your needs and building a lifetime friendship with you". Once the deal is done they basically you off their grounds and slam it in your face.

You might look into getting your local media involved. That is assuming they have a Ombudsman type person. The last thing any business wants is negative promotion. I have seen it here in my area and it can ver very powerful.
Maybe start with a letter threating to take this issue up in a public forum.

I still don't understand how one can drive off the lot in a new car that they thought was a touring model and not realize it wasn't a touring model? The minute I would get in the car and hear the crappy base stereo, not find the buttons for the power seat, not to mention the fact the seats weren't leather.....yikes. Why did you want the touring to begin with if you didn't know what features the car was supposed to have?
I would call Nissans Corporate Consumer Affairs and the owner of the dealership. Stop playing games with the sales manager. Barring you dont get satisfaction from one of these sources, you really dont have much of a leg to stand on. You got screwed. I wouldn't give that dealer another penny though under any circumstances (above and beyond what the original deal for the touring was supposed to be!!!) If its going to cost you to get a touring, then pay a dealer that might actually give you service.

If your contract states in writing that your car should be a Touring model, oppose to a base model, you have a very good legal claim. I would talk to a sales manager, then the regional manager. Document every little detail. Mail the dealership a certified letter with your complaint.
If they refuse to help you contact an attorney. I believe you have a pretty good case. Good luck.
