I also am curious to know how insurance is dealing with this! Keep us up to date!

After pegging two lightpoles in the past myself, you're car is totaled. I wouldn't even let the insurance company try to fix that.

Round 1

+1 for kid
0 for Z

Winner......KID with a great assist by tree.

Sorry to see the Z get a face lift.
Can you explain exactly how it happened? what speed were u doing, were u able to slam the brakes or was swerving your 1st reaction? could you have driven hard around him. Just wondering an alternate reaction is all. (not being a dick)

It's a wonder that YOU weren't seriously hurt, airbags or no. That is one hard collision with the tree. Trees always win, and yes, your car is totalled. You wouldn't want it back anyway after that.

I had a similar situation (to hit the kid, or not to hit the kid?) a whole bunch of years ago. I also chose to miss the kid. Good thing you did too; if there was even one witness who decided to claim you were doing 1mph over the speed limit, you'd be hosed for life if you HAD hit the kid.

this thread should be titled "this is what happens when you drive too fast in a neighborhood and you swerve to missa kid in the road".

for all of you stating you would hit the kid, i hope it is yours that gets hit

got any parts to sell off the car?

Having treated kids in the ER after a car vs pedestrian...its bad. I wouldn't wish that kind of pain on anyone.

Hate to admit it but I'm with Zo4 on this one(I kid Z04)...if you were going fast enough to lose control, then you were going too fast. color me shocked if you didn't get at least one ticket.

Just be glad nobody got hurt. Knowing you killed someone is much worse than knowing you totaled a car...It doesn't matter who's fault it is that they died, they still died.

How fast were you going? In neighborhoods thats why the speed limit is 25, you can swerve and not destroy your car.

Kid's parents need to be found and charged with child endangerment, and your insurance company should take them to court for repair costs.
