do i have a shot at using lemon law ?

Default do i have a shot at using lemon law ?

Monday i will be going for my second tranny at 6K miles ( first one was replaced after 600miles ) , also i had window grease "repaired" before and radio replaced , now monday i will have them check and fix the following:
- Transmission
a) grinding noises when changing gears
b) hard time to put in 2nd , 4th , 6th gear while driving or won't go in at all

- Noises coming from the rear ( possibly rear axles ? )
- Noises coming from engine bay when car is running in neutral and clutch is not pressed fully down
- RPM’s jumping – rough idle
- Driver window hitting door frame
- Windows hardly go down when opening the door
- Door weather strip worn out from window hitting it almost making holes in them
- Water coming through drivers and passengers windows when its raining
- “slip” light came on while driving 60 mph on a highway and it stayed on until car was turn off
- low tire pressure light came on , after checking the tires I had 37psi in each
- seats stay warm at all times
- radio has to be replace again..


my question to you guys is : even if they fix all those things , can i apply for a lemon ? or do i have to wait till my tranny goes for a third time and then come back with a stronger case ?
basically im trying to get my money back from nissan , too tired with this car ....
im in NY area if that helps , thanks

lemon law applies to cars that needs to have same problem fixed three times. So it doesn't apply in your case unless your third tranny fails.

And you have to be careful to have the problem worded the same each of the three times. I had a problem with one vehicle 5 times, but since they worded it differently, I got screwed.

maybe you should read your complaints again, is this the first car you have owned? It looks to me like you complained about your window issue, three or four times.

your window problem is your window regulator, I think mine went out when I got real bad ice on it...and the windows were trying to go down when I opened up the door.
everything else you have....well join the club
I dont have trany problems though

Zexpolosion thats the stupiest question i ever got ? whats that got to do with anything ? wanna know how you figured that one sherlock , what are you 15 ?

for the rest - thank you for your input ,
hopefully my tranny goes for the 3rd time before this winter...

Before you go any further, contact the NY department of Consumer Affairs and get there defination of a "Lemon" Then take it from there.. I believe you have to have the car tied up for the same repair for a certain number of days over a certain period of time. Every state is different. I do know of a friend who spent over $100K on a Mercedes S600. It spent 45 of it's first 60 days in the shop for many major problems.. They ended up buying the car back..

a bit too late for this post, but i am in the legal system, my Z is giving lots of tranny probs also, the lemon states that all a car needs to qualify for the lemon is *if u think the prob its gonna lower ur resale value, and the "CONDITION" not prob is the same* then it is a lemon. condition qualifies the car in many more aspects then different specific problems. i.e...if u have a tranny prob and have taken ur car into repair for different issues, then that "CONDITION" makes the car undrivable. hope that helps

My second tranny replacement on the Z had a notchy 2nd and 5th gear. But my G 6MT tranny has no notchiness in any gear. I think you guys should fight to get it replaced properly.

Lemon Laws vary from state to state.

As such you cann't generalize and say that "X" number of trips to the dealer for the same problem will constitute a violation of the lemon law in every state.

Like the person before me said, you just have to do a little research. I just looked at the New York Lemon Law and there are two parts to the 'reasonable attempts' (1) four or more times with the non-conformity still present. (2) out of service for 30 or more calender days for one or more different non-conformities. Both of these have to be in a 2 year or 18K mile period.

If your car has been in repair for 31 days as you state, talk to a lawyer. You can find a free one at http://www.lemonlawamerica.com, or pay someone $100 for a consultation.

Get your tranny fixed again so you have some slack for the 30 day rule, find a lawyer, and JUST DO IT. Stop complaining about it and take action, as I have done with my car. It took me 5 minutes to look up the information I just gave you!
