Car Wash Damage

I did a stupid thing last week and drove through a car wash. The thing malfunctioned several times and at one point the brushes stopped spinning the the arm they were on continued to moved. The brush arm swung around and since there was no power to them, it slammed into my fender. I felt it move my car when it hit. Once I pulled through, I got out and pointed it out to the guy working there. The manager comes out, says his car wash did not do that, and basically called me a liar. I know full well that if I place my car at that point along the tracks, the brush will hit that spot, so I am not worried about whether or not I can win in court ($1039 estimated damage by Nissan dealer). Are there certain attorneys that handle this kind of stuff, or should I just start calling them up?

Either go to your local law office and tell them what happened and ask if they can help you, or ask your friends/family for a reccomendation to one. Sorry to see that happened, you shouldn't have much trouble getting them to pay for it though.
I happen to know one of the best traffic lawyers in NJ and PA, and used him a few times. He may be able to help you, not 100% sure since its not a traffic type thing, but he's a lawyer nontheless, and a damn good one. If you want his contact info to see if he can help you, shoot me a PM.

well first I hope you learned your lesson. If you're going to use a drive in carwash, always use a touchless one. Even then, be wary of the detergents they use. Second, good luck trying to prove the machine broke down during your wash. I believe there are disclosures before entering automated washers that claim no fault for damage.

Poor guy already admitted he did something stupid (his own words) Don't believe he needs to be reminded by all those perfect peeps out there. Just a thought... Agree with David though - insurance claim or try small claims court yourself. Or both to try and get your deductible back.

$1039 in damage? WOW! Is that to replace the fender? I had a ding similar to that as a result of a rogue shopping cart from Target. Paintless dent repair was about $150 to pull it out. Sorry to hear/see this though. Car is nice and shiny though. Good luck!!

wow that sucks to see this happen to you i hope you fight this through since its not your fault and its sucks to have to fix something that you clearly did not do damage in the first place wish you the best of luck

Small claims (as indicated several times above) would be the way to go.
