Default Getting down payment back

Does anyone know of a way to get my $1,000 deposit back. I am getting another Z, so I do not want the one that I ordered. I have had lots of trouble with my dealer. I just want my money back. Nothing else. They are going to make at least $3,000, according to my dealer on some of their other cars. A good dealer would give the money back, a bad one would not.

Can NNA help with any of this? Any suggestions?

My dealer gave mine back. Have you tried yet? Logic would tell you that they would be praying for people to back out. It makes no sense to sell to you at MSRP when they can find some sucker to pay a premium the minute you walk out the door.

I ordered 2 Zs and backed out of my first one because they wanted to charge me 3k for chrome wheels.........before I ordered, I made sure that the dealer would refund my money if I cancel my order.........so I went down to the dealer, asked for my money and they credited my credit card the next month. Everything was good.

I spoke to my dealer and he said it was the law that they could not keep a deposit if you did not take delivery of the car.

What state is that? And exactly where do I find that law?

If the dealer won't return it, simply tell them you are going to sue them amd report them to the local Better Business Bureau. I will bet you will see a sudden change in attitude especially when you pick up the phone in front of the sales manager and call the owner of the dealership. If they still won't return your money file a suit in your local small claims court and have the dealer served. I don't think you will find a court in this country that would allow a dealer to keep your deposit when you did not take delivery, especially if they sold the car to someone else at a higher price. I think you will find the dealer more than willing to return your deposit especially if you talk bad about them in front of other customers while they are trying to tell them what good guys they are. Dealers already have a bad reputation and they won't want to loose more business while you complain about how unfair they are in a VERY LOUD voice in the middle of their showroom. If they won't budge from the antics you pull in the showroom, I am sure the judge would help them change there minds in court. While you are waiting for your hearing date, letters to the editor and talking to local newspaper and tv news people can turn up the heat too. Have fun with it. Then slowly drive through their dealership in the other Z.

How about this? Just buy the second Z & put it up for sale immediately... You could probably even ask a few hundred over sticker (say $500), sell it quick & pocket some cash for your effort. Of course there might be some drawbacks....

1. You may have a problem with financing (unless you've got the cash)
2. Once it's titled, it becomes a used car, so a prospective buyer can only get used car financing... but, with interest rates as low as they are now, I don't think they're much higher....

Just a thought......

I have spoke with the manager and the owner, both say no refund on the deposit. I am an insurance agent and I can greatly affect their business. I told the owner that and he said, I don't think you have any ethics. I said I don't care what you think if I get screwed on this he will lose 10's of thousands of dollars. The owner said he would contact his Nissan regional manager to see if my order could get bumped up. What the hell is that? Is that the reason that the one's who ordered early are getting theirs after other people? He called back and said that the regional manager was calling NNA and I would hear back from the manager of the dealership. That was on Friday the 23rd. Guess what? Still no call. Just like everything else from the dealer. Crappy customer service.

If I have spoke with the manager and the owner, and both say no, where do I go. I am thinking about one more call, after I get my other Z. After the one last call, I will contact NNA and then the better business bureau.

What do you guys think? Am I the only one that has this crappy of a dealer? I know that there have been some bad stories, but if anyone is having this kind of trouble let me know.

How much of a deposit did you make? Haave you thought about calling NNA? I just don't know if it would do any good.

If your state allows non-refundable deposits on cars, then you're somewhat at the mercy of the dealership. Luckily CA law doesn't, no matter what is written on a contract. So check your state laws. I'm not a lawyer.

I would try printing out the picture bobbyz posted, and proposing this to them

- if they refund your deposit, you will be glad to walk away so they can mark it up
- otherwise, you will take delivery at the agreed MSRP and sell it for the markup yourself

If presented like this, I doubt they'll force you into buying it at MSRP. It sounds to me like they just want to keep your $1000 *AND* mark it up for someone else.
