350z was in a wreck previous to me buying
Ok so I found out from a Nissan Dealership that my car has been in a wreck prior to me owning it.
The frame is bent somehow so it is very noisy in the back. Like on the right side of the hatch, is a tiny tiny opening into the trunk space.
And they said because of the accident, the alignment is slightly off.
Heres the catch though, I got a carfax report on it, and the accident was not on the report, so I'm having to call the original dealership I bought it from (not a Nissan dealership) and see if they will pay for the repairs.
I'm taking it to a body shop tomorrow to get a second opinion to see if it can be aligned without fixing the frame, but we will see.
What do you guys think about this situation? Should I get my money back for this car and look for another Z? Or just see if the damage can be repaired?

You bought the Z "as is." Probability of getting your money back is slim to none.
A frame machine can do wonders for a bent frame. Fix the frame. Poor alignment is not the only problem. Other problems may be hidden.

^^^ Exactly. Carfax is not perfect. Unless you got the Carfax guarantee, then the omission from the Carfax report is not the selling dealers fault nor Carfax.
Unless the dealer (in writing) represented the condition of the car to have never been in an accident, you have no recourse. A used car is always "as is". Even if "certified", all they are certifying is the mechanical aspects of it, just like a factory warranty would.

How long have you had the Z? If it is more than a couple weeks, I think you are out of luck getting any money from the previous dealership. It is possible the selling dealership knew nothing of the car's past history This is the reason you should have a used car inspected by a reputable mechanic prior to purchase.

From the Carfax site:
"Not every accident or damage event is reported and not all reported are provided to CARFAX. Details about the accident or damage event when reported to CARFAX (e.g. severity, impact location, airbag deployment) are included on the Vehicle History Report. CARFAX recommends you obtain a vehicle inspection from your dealer or an independent mechanic."

I repeat: Carfax offers a limited warranty to the purchaser of the report. It may not help in most scenarios (depends on whether a branded title is at issue), but it does exist.

"CARFAX agrees to pay to the holder of a CARFAX® Vehicle History Report (the "Report") making a Claim (the "Claimant") the Claimant's purchase price of the vehicle to which the Report relates (the "Vehicle") up to 10% over the Kelley Blue Book value (see terms 8 and 9 for details) if the Report states that the Vehicle has a title history with no Branded Titles showing, but a Branded Title actually exists."

They had to claim the car damaged for it show on a carfax.. for instance: you wreck and decide not to go through the insurance, you go ahead fix the car out of pocket. That doesn't show up on the report.
I might be wrong on this:
But if u were to crash ur Z and did the repairs your self out of pocket without insurance then carfax would have no idea about it, but if u get a repair like that done through insurance then they will report it to carfax??
Not sure if I'm right but this is what I was lead to believe about "carfox" lol

UPDATE:
Ok so the Nissan Dealership called me and asked if I want to come in to trade my car in to see if I can get a different 350z. Im going in today around 3ish to get it appraised, just to see what they offer.
Who knows, getting a different z, may be cheaper than the repairs right?

Find out what it cost to fix the current car and use that to decide if it's worth it to replace it with another. Any deal that the Nissan dealer gives you has to factor in the repair cost or diminished value. My guess is that they will offer you way less than the "value" of the car. You'll buy something from them so they make a sale, that's all they're interested in. They will take the current one and farm it off to auction meaning that they won't offer you much for it since they won't get much for it.
The bottom line is without actual numbers, this is all speculation. We don't know what you owe, what the car is worth, what they will sell you another for, etc.
