I don't think the lawyer would charge you unless you win (that's how my lawyer does it). And I feel your pain....I bought my 08 with 15k on it (mint condition) in August and got T-boned in September causing $5500 in damage...talk about loosing value I really think you could fight it and win with a decent lawyer though.

When she pulled out of the mall complex was she at a stop sign or was it a merging lane into the lane you were traveling in??

Also, why were you only going 25 in a 45, and based on the damage you listed on her car, how did you not have enough time to stop from 25-0?? We're talking under 10 feet here at least....

In Texas if you pull out of a private drive or you turn from a other street that person has to yield to you. If they pull out in front of you its there fault. I do a lot of accident reports on that. Did she tell the police that she came from the other street or private drive?

lol i forgo to add the movement lines of the minivan.
It is a 45 road but people usually go slower there until you pass the elementary school a block ahead.
Some of you are saying that I should have saw her and could have stopped. BUT she drove into me..I dont know how else to describe it.. When my car was about to pass her, she drove into the lane and her rear hit me as she made into the lane. I really think she did not see me at all..Its crazy if she saw me and still went..
If she would admit to the accident, i would not feel AS BAD. But lying about it and trying to put me at fault makes my stress level go up!!
And I have to pay 1000 deductible and even at that my insurance was high enough already without this occurring ...
I am thinking about going to the lawyer soon. I feel... indignant? lol

Default Not your fault?

Contact the police officer's supervisor and ask for a meeting with him, the "investigating" officer, and the other driver. Bring pictures and a written and signed statement of your version of how the accident happened. Be courteous at the meeting. Politely ask how it was determined to be your fault. They may possibly change the citation and the accident report. At the same time, contact your insurance company and let them know you are disputing that you were at fault.

they say it is his fault because if the driver who pulled out in front of him had time to pull out. Then they say he had time to brake and avoid smashing into the van. NJ rules of the roads DO suck!!! Specially if they determine what kind of speeds you were doing then they can also say the accident COULD have been avoided if you were going the stated speed.

Just last night over on Borden Town Avenue in the South Amboy area this idiot at the corner gas station where the intersection is by Ernstin Road pulled right out in front of me while i was flying down to make the light. Lucky for me i have WILWOODS!!!!!....

There is really nothing to get so excited about here. The original poster just needs to have is insurance fix the Z. Then let the two insurance companies decide who was really at fault. If the original poster is found to be innocent, the insurance company will return his $1000 deductible.

If the accident report says a driver was at fault, then there will be no argument between the insurance companies. The "at fault" insurance company will pay all damages less their insured's deductible.
