I don't quite see how he is going to sue the dealer for negligence, its basically his word against the salesman's, and even if the salesman did tell him to do that, I don't think it would be his fault anyway.
Hmm, They didn't pull my credit before I took my test drive. Certainly sounds like a good idea on the dealers part though. I don't think he's liable at all but I certainly don't think he can sue the dealership either. I don't blame the owner for trying to bully the sale to keep from having to take the hit. The car has to be fixed & can no longer be sold as new.

and yes the guy driving the car is fully liable since he was driving. be expecting to be sued by his insurance company, they will sue your insurance company for the damages. though i dont think they can make you buy it. that is of course if this really happened...

Actually, It's the registered owner of the car who is ultimately liable, not the driver.

Just as some follow up...

PoWeRtRiP: I'm 21. I drove a 99 Trans Am WS6 6 speed when I was 17 until I got rid of it when I was 19 and came to school. It was a fine car with a godo deal of mods... if you'd like to see it check out http://lswaidz.home.insightbb.com/trans_am/.

And as far as how it happened, I wasn't in a turn it was off a dead stop into an intersection. That's why this was so crazy as even in my Trans Am which had a lot more horsepower at the ground than the Z, it NEVER reacted to sudden throttle input like that... this was a 2003 Enthuiast... I don't believe it had any mods or anything special at all... the road was completely dry unless I missed something... it was just the damndest thing how it all happened...

well sorry for doubting its jsut we get a lot of ppl on the boards that make up some wild s$%#. that is crazy though for it to spin from a stop, mine usually gets real squirrelly if i launch hard but its got some decent boltons on it. good point about it being the registered owners liability i hadnt thought of that but they can make you pay for the deductible im fairly certain. but 3700 in damages is not too bad. the rims are what will drive the repair price up bc they run 600/piece and the tires are about 270/pc. it probabkly just has some suspension damage on top but its definitely fixable.

He lives in IL so I guess the hardend rubber helped spin the car

He is NOT liable for any damages. That is why the dealership has insurance. Liability and fault are two different things.

Unless he signed some sort of disclaimer, he is basically driving under the dealership's name.

Someone on the BMW forums crashed a brand new M3 because of slick roads. He went back to the dealership, handed them the keys, with the guys screaming at them, and left. Didn't hear anything since.

Thank god I'm a pre-law student... I can be my own attorney! Kidding of course... I've been on the phone with my insurance company all day and they said I can wah my hands of the whole ordeal and they're going to handle everything... that sure is one hell of a car though, when I get mine I am never doin **** like that again and I'm just gonna go ahead and put a nice cover over that TCS button so it never gets accidentally pressed... I don't think the model I drove has VDC though so that may have contributed to the loss of control.

You better check with your insurance company, they probably will pay the claim, and then the next thing you know your rates will rise.

They should, you wrecked the car!

zand02max your a stupid ***. if you actually read this thread, he even POSTED a link to pictures of his TRANSAM. yes and it does work. and he's not "blaming" mechanics. geez...i don't understand these people that go psycho over something that's not even their problem and even go about twisting other people's words.. if you were the dealership's manager or something, then maybe whatever... say what you want. but you're not so quit being a *** and let him be. damn people didn't start this forum so that people can chew him out when he's just venting his problem or looking for advice.
