Unhappy so i just found out on my new 10w7...

that it has some kind of finger nail puncture on the side of it, and i was wondering if it will be a problem?

if it is broken all the way through the foam, it will most likely develop into a larger hole.

It is a scuff or a puncture all the way through? Have any type of warranty on it?

This is important information. If it is a puncture, you could likely fix it with some flexible epoxy. It is close enough to the outside edge that it probably won't rip.

If it is just a scuff or scrape, I wouldn't worry about it. The foam surround on those subwoofers is pretty good stuff and won't easily tear.
