Default Sounds like stuck caliper?

Hi, I started smelling burnt brakes while driving home from school, then my gas pedal has a slightly weird vibration and it made it slightly difficult to accelerate. Once I got home, I did a walk around, and what I found out is there is a lot of heat and smell coming from the Rear Driver Side brakes. Upon further inspection, the rotor of the same corner is scratched. I searched the forums and it seems like all signs are pointing to a stuck caliper. Are these pretty good signs that its the caliper getting stuck?

Also, I went ahead and searched for replacement calipers. I came across a pair of USED 06-08 rear calipers for 85$. versus one NEW 03-05 Rear Driver Side caliper for 45$. Both of which were on Ebay. Which of the two would you 350z gods choose if the problem turns out to be a stuck caliper? If I were to buy the 06-08 pair, will my 03-05 akebono pads fit them?

03 to 08 non Brembo rear calipers are all the same.

I would probably grab the rebuilt one

^^^ Yup, agreed.

Used calipers *should* always be rebuilt anyways. No telling how long they've sat and with any mileage, the pistons and seals could use a refresh. Never cheap out on brakes or tires. Never.
