Dealer trying to F-me over!!
Well I purchased an 07 Enthusiast 3 weeks ago. Traded my 06 in and had roughly 2.5k positive equitity. I sqeezed out an extra 2.5k from their first last offer. Well today the finance manager called me up and asked where my money was! He said I still owe them $2500.00 I said "Are you kidding me??" I specifically told them I am not putting any money down and using the positive equity as a downpayment plus $300 deposit I put down in order to secure the deal.
I financed through nissan at 6.9% I am payin $505/month@72months. I already sent a payment of $9000 to nissan the week after I purchased the car. Now my calculations dont add up. They said on the purchase order, which I will go over when I get home from work, that they put me down to $5000.00
Is this legal? They are trying to get extra cash from me after the deals were finalized. I remember going through the papers and not seeing any of this. I could be mistaken. We're after all human and make mistakes. I refuse to pay an extra $2500 to the dealer. I think they are tryin to pocket this money because they are losing out on my 2006.
I know for a fact they are losing money on my 2006 because I know a lot of the workers at the dealer as I work with them throughout the day ( own a junkyard ) The guy who takes care of the used cars depts says they are actually auctioning off the car due to the fact they cant make a huge profit. I don't know Maryland state law but if there's something written in a signed contract and before/after something said orally the written contract is more than likely the actual enforceable contract. In real estate oral contracts are not acceptable at all. So as my dad told me nearly 40 years ago ... always get everything in writing.
The dealer is more than likely using a written contract that you signed. If so you're more than likely "screwed" out of the $2500 as that's the contract you actually entered into when you put your signature on the bottom line. Here in California there are like a dozen places where you have to read (note that part) and then initial various clauses of the contract - and the cost, interest rate, trade in value, and payment terms are all spelled out in rather plain language in big letters.

The numbers on the contract are what they are. There is no room for negotiation.
If you sent Nissan $9,000 after the loan was finalized, your terms (monthly payment) remain the same. Only the number of payments changes.

Dealerships do that all the time. They want the car off the lot.

Call the dealer and tell them that you have gone over your contract and see that you do not owe them any more money and give them a chance to rebut.
If they do not have a valid argument, tell them good day.
I have heard of dealerships "Stealing" or repossessing cars that they have a disagreement over payment with the buyer before.. Be Careful.

dealer is tripping. He even remembers me saying Im not making a downpayment. He asked me if I want to make a payment plan for the remainder balance with him. He said hell take care of it wti the dealer and I just pay him back. Man the nerves of these people at the dealerships. I never liked calling dealers stealerships since they too have to make money and live but man this is a true definition of STEALERSHIPS!! He gave me his cell phone and told me to call him tommorow on his off day since Im too busy to go over there now. Am I on crack or something?

when i bought my 04z, i had it for almost a month when the loan company called me and said they needed more info on my credit history before they would release funds to the dealer! when i called the dealer to ask whats up they just said that happens sometime, i wondered why the hell would they let me drive off in the first place, anyway everythings worked out, i guess buyer beware.
Ive heard of these stories from time to time. There was that really bad Chevrolet dealership that kept popping up with these stories.
If you have all your paperwork, and it all looks legit on your part, then just go there and ask them to show you where it says all of those rediculous things. Its fun to make the finance managers look stupid every now and then!

Does it say $2800 on the down payment line? If it does, you probably owe another $2500 in cash. The trade-in amount (deducted from your purchase price) and trade-in pay-off amount (added to your purchase price) are listed seperately from the down payment. Cash down and trade equity are on separate lines on the contract. Scan or take a digital pic of the contract and post it here (or email it to me) and I'll show you what I mean.

shady dealers are shady dealers - and contracts are contracts
read your contract, line by line, and you should easily be able to figure this out for yourself. If not, drop a lawyer a line, send him a copy of your contract, and they can tell you what all is involved. Otherwise, posting the info here, without showing the contract, is really a waste of your time, as well as everyone else's. Purchase contracts don't leave room for interpretation...they are black and white.
The money you have sent to Nissan after the fact has nothing to do with this scenario.
