Default Tax and smog check in California

Hi guys / gals,

If I'm buying from a private party (in California), do I have to pay tax?

Also, if the car is older that 4 years (2003), does the seller need to do smog check within 90 days?

Yes and yes. You pay sales tax when you go change the title at the DMV. They take the tax from whatever sale price you've put on the title.

You have to smog 2003 for change of ownership. By law, seller is responsible for smog.
