Default Transmission HELP!!!!!

ok here we go. Last friday I was coming down the highway and putting it in 6th gear and it sounded like I missed and then I looked down and it was in N but according to the RPM I was in 4th. Then I tried switching gears and the gearbox was locked up. So I drove to the nearest Dealership and dropped it off at Modern Nissan in Winston Salem NC. So today I finally heard sumthing from them and he(Ron) opened it up and said it looks real bad and it is not gonna be covered under warranty bc of abuse! He started giving me prices that came to about 3500$ w/o labor. Asked him why he opened it up and he said bc he told Nissan that I had peformance parts so he had to. I have Popcharger, AAM TPs, and Pro-1 exhaust! He quoted me a nismo flywheel bc it was cheaper! AnyWays I msg Alberto and asked 4 his advice since he is on his 4th tranny. He said that it should be covered and if not to call Nissan North America bc they know about the SH1TTY transmissions we have. Talked to a lady that was real nice and she was pretty much the messenger so she is gonna have a head hanco call me in the next buisness day. IDK what to do. Yea I have given it a lil fun but cmon sum people are on trannys that have 500+hp. And yes I can drive but I also bought the car with 5K miles on it from a kid where it was his 1st manual car I know there has been about 10 times where i have shifted into gear or dumped the clutch and the clutch peddal got stuck so im sure that had a lil to do with it. I went to the dealership 1 time and told them that and they said they have never had that prob and unless I can prove it they cant fix it. Just help me out guys PLEASE!!!!!!!!!

I have to agree that this is a warranty issue. Like we have said many times, unless they can prove that your aftermarket parts caused the problem, then they have to fix it. Also, ask your dealer to open the owners manual and show you the abuse clause. Actually, make sure there is not one first. Frankly, this is just bull.

Oh, and you know how many times I have blown a shift? Hundreds. I also race my car. I just changed to a performance clutch and flywheel. My stockers looked and functioned perfectly after 70,000 miles and the tranny is great. I HAVE AN 2003 TOO. So, if mine has survived, then yours is just a bad tranny. Nissan has to pay for bad trannies, not you.

+1 see IDK if they are saying that my bolt ons did it but they are def saying its abuse. But like u said i reall think i have a bad tranny!

First of all you shouldn't tell them about the history of the car regarding the little kid. By doing so you are stating your knowledge of prior abuse. That is a valid reason for them not to cover the warranty. Treat it as if you have no idea why this is happening except for the fact that this is a warranty issue. The mods that you have on your car should not affect the transmission, and as peptidbond had mentioned under the Magnuson-Moss Warranty Act, they have to prove that they were the cause of the failure. Your best bet as of now is to try another dealership first. The car is still driivable right? Tell them to put it back together because you want a second opinion. You need to mention that up front that you are aware of the transmission issues Nissan has with the older trannys. Talk to the locals in your area and find a mod friendly dealership similar to West Covina in Ca and Courtesy here in Dallas. My 3rd gear started to grind I brought it into the dealership stating the warranty. The service guys was aware of the issue Nissan had with the transmission and ordered me a CD009 without even test driving the car. The tranny came in less than a week and they put it in plus performed the fuel recall in just one day.

It doesn't sound like they're denying the claim because of "performance parts", they denied it because of abuse. The presence of "performance parts" only prompted them to open the transmission up for further inspection.

Short of having a FI engine, there's no way they would claim that performance parts caused any problems. All they have to do is look at the clutch and see a few burned spots and they're going to use the "abuse" card.

Your best bet is to fight it out with NNA. The dealer has no incentive to force NNA to accept it under warranty. They both make more money having you pay retail for a new trans and install.

Nice info man, just wondering which service guy you talked to in Courtesy Nissan?
