See this thread, print the TSB, and go to a different dealer.

Yup, Print the TSB and take it with you. When I took mine in and I told them that it was using oil and I needed a test they told me "Its a sports car, thats normal" I said "no its not" and took out the TSB and showed them. 1000 miles later I got a free new motor.
i downloaded T S B wil do as recomended should i get a lawyer to go with me to dealer as a witness and are they allowed to tie the dipstick down so that i can not see oil level, last time i took it in for oil consumption test they did everything in the garage w/o me present. ihad to take thier word and i dont trust them

You shouldn't need a lawyer with you.. but I guess it couldn't hurt. lol. If you do not trust the dealer, I'd strongly recommend going somewhere else. If they do say you need a new engine, do you really want them working on your car?

If you're not satisfied with Nissan helping you, call Consumer Affairs. If they won't help you, get the Better Business Bureau involved, that's what they're there for. Don't just rush to a lawyer...
I called the BBB and got offered a new engine within 24 hours. This came after going back and forth with Nissan. They were giving me the run around, and blaming the problem on my aftermarket stuff, and other random excuses... Nissan replaced the engine twice, before they got it right, and the BBB was right there to help every step of the way.
Call Consumer Affairs. If that doesn't work, escalate to the BBB.
1 quart over the oil change interval (~3750 miles) is considered "acceptable" according to the Nissan Regional Specialist that was handling my case...
