One headlight is not as bright as the other
I recently had my passenger side headlight replace due to an accident for my 350z 2008 and before noticing the problem I decided to switch to 6000k bulbs to help see clearly at night. The results were great, however, I notice that the driver side light was brighter than the passenger side. I began to think that the dealer gave me a 03-05 headlight or an aftermarket 08 head light that cause the passenger side to emitt less light than the driver side.
I have done some research that the 03-05 headlights do no come with hid kits but 07-08 does. Are the headlights the same for all years except 03-05 not including hid kit or is it that 03 headlights do not emitt as much light compare to the 08 headlights?

Both headlights pictured look like OEM 06+ units. You'd see a big difference in physical appearance if one was an earlier type headlight.
I'd bet you bought some cr@ppy Chinese bulbs, and it also looks like the right side bulb isn't seated properly in the headlight reflector.

It's a bulb issue - look at the beam pattern, especially in the third pic. I had the same issue with the junk bulbs from Diode Dynamics in my '08. Changing back to own bulbs fixed it,

The dealer did the bulb installation. I might have to go back and tell them to see the problem.
Luckly, I accidenly bought two pairs of bulbs so I will see if the bulb is an issue.
The most obvious thing really is the difference in beam pattern between the left and right lights - that's what indicates an incorrectly seated bulb on the right side.
The oem bulbs. if that's what you really had, will provide the best light output, both in terms of brightness and coverage. If you need an aftermarket replacement for them, choose from Philips, Sylvania, or Osram, for similar performance. Some may not like the oem bulbs because 4300K isn't blue/white enough, but light output decreases as the color temp increases.
