Dealer denying warranty claim on tranny HELP!!!

Exclamation Dealer denying warranty claim on tranny HELP!!!

Okay, so i take my car back to the dealer for the infamous gear grind and drop it off to get checked out as usual. The service guy calls me up a few hours later and tells me that they see that the car has a 6th gear grind, BUT they won't fix it again under warranty because i have a modified intake and exhaust. Mind you i got it replaced 11 months ago at the same dealer with the same parts on the car. I told him the parts have nothing to do with the tranny going bad and that it's a known problem, he tells me it's not a known problem and that the "increase in horsepower" caused the synchro to go bad. At this point i was like BS! He's not listing to anything i say so i dont know what to do now. I've always had trouble getting work done at this dealer and it's by far the worst service I've ever gotten. How can i get him to honor the warranty? Any help is appreciated. Oh yea, also my power train warranty is up, but I'm within the 12 month/12,000k limited warranty. Thanks

go to another dealer or contact NNA. increased HP have nothing to do with syncros going bad

Explain it to him this way. Your '03 engine plus an intake and exhaust barely put out 300hp. The Revup engine and the HR engine both put out the same or more than your engine does. They all have the same tranny. If it's good enough for the Revup and HR, then it certainly ought to be good enough for your slightly modified '03 engine.

Yea, I've already contacted NNA and am waiting for a call tomorrow from a rep. It's just so frustrating to speak the service manager there, it's like talking to a brick. I've been civil with him but i'm gonna go off if he keeps telling me b.s. that i know isn't true.

I wish the other dealer wasn't 50 miles away

58,731 miles

The work will most likely have to be done by that dealership since the warranty is with them. It sucks because now you have to get people that don't want to see you or deal with you to fix your car. They'll most likely screw up the next replacement as well and you'll be back again. If you can get the other dealership to make the repair you'd be better off; depending on that dealership demeanor...

Build date has nothing to do with your warranty, it's the in-service date that matters. They date that you or a previous owner took delivery. In any case, you still have your 12mo/12K mile replacement part warranty.

I brought that up, and you know what he tells me! He says "We don't have to prove anything, we can deny anything we want". I would honestly grab my keys and run out of there if it wasn't the only dealer near by. My warranty ends soon so time isn't on my side either. I'm calling my lawyer tomorrow to see what i can do.

have that dealer write down why they are denying to honor the warranty. Then you have something that will stand up in court. I would also contact the GM of the dealership, and quit messing with the service writer/manager. Also contact the BBB and file a complaint against them.

I got a call from NNA today, they're reviewing the case and said they'll have a decision made by tuesday..........this whole situation blows.

You're in Pembroke Pines? Well I went through the same thing here at Maroone Nissan on Pines blvd. Every single time I have an issue it takes about a week of my harassing them for them to fix my car. I'm getting sick and tired of it. I'm never buying a car from that stealership ever again. It's sad that a handful of dealers give all dealerships a bad name (World Ford always fixed my mustang no questions asked)

exactly, if it comes down to that, i would drive 50 miles for service if thats the closest place. i wouldnt go back there. during the time when i had my tranny replace due to grinding, i drove my car in with a popcharger, greddy evo2 AND TEST PIPES. my cel light was even on too. power nissan in el monte, ca didnt give a crap, they just made fun of my car cuz it smells like gas

It blows me away that dealerships are such a pain about doing warranty work. It's not like it's coming out of their pocket. They get reimbursed for the work done.
Unfortunately, many service department really aren't. They are just the second sales department. It drives me nuts when I hear them trying to sell something to someone that I know they don't need. "Since you've got nearly 20K miles, we're gonna need to replace that timing belt"...
Integrity would be a nice thing for them to develop. Guess that costs too much.
