well i just got my decision from BBB... 12 page letter , first 9 pages were my problems , confirmed by BBB , then it was their reasoning for the decision , i met all the qualifications for the lemon. Now this part i dont get:
First it says ( among other problems ) that my radio/cd player was replaced 6 times and still doesnt work , problems with the windows x 4 ( plus other problems ) and under it , BBB's decision. Decision that Nissan has to repair my car because the manufacturer didnt have a chance to fix the problem ? ...
so I got myself a lawyer , who was more than happy to take my case , I guess going through BBB didnt work for me , although i thought i did really good at the hearing...

i just had my inspection day this past week, to give nissan one more chance to fix the car and guess what. the inspection guy went to the wrong dealer. so instead of having an inspection i was waiting talking with nissan arbitration at the service center. as you can imagine i was livid. luckily i kept the Phone number for my nissan arbitration specialist and gave him a call one hour before inspection and at the inspection time (10am) it directly connected to his office.

i expressed my displeasure calmly and intelligently(cause i know i'm being recorded) and they accepted full blame. of course they wanted me to reschedule another inspection. now knowing that at this point i held all the cards because I GAVE NISSAN THEIR LAST CHANCE TO FIX THE CAR AND THEY BLEW IT. right of the bat i declined saying that i didn't have another day to waste so they immediately offered to pay my salary for the 2 days missed for compensation. after bartering i finally agreed to schedule another inspection in early march. they inturn offered to pay for one of my car payments ($608).

bottom line even after they "fix" the problems i have faith that the things they fixed will break again. then i'll have an air tight case. i'll keep you posted on the results in the future.

Be careful accepting a check from NNA - make sure your right's are clearly understood an that you're not signning away you rights for buyback/repair. They offered me a check back in Nov. '03 and I flat turned them down because it was "hush money".

You should have told them that they had their one "final" repair chance and blew it - you should have said: "You'll be hearing from my attorney". Do you think NNA would have given you the same respect back if you missed an appointment? Doubt it.

yeah i wanted to just go to trial, but my lawyer advised me to make sure Nissan inspects the car and tries to fix it one last time and not just try to get out on a technicality. the lawyer tells me i have a great case but i should still follow all the steps before this goes to trial. i've gone this far, might as well do everything to make my case air-tight.

hope i did the right thing.

Tranny replaced
AMP replaced in Bose stereo
Grease streak
tires feathering
pulls to the right
gas cover doesnt always pop
hatch doesnt pop

I think I have an exhaust leak now from the idiots not putting the exhaust back on correctly
