Thumbs up 2nd Speeding Ticket.....dismissed, again!!

Woohoo!! I got my 2nd speeding ticket dismissed today. The arresting officer transferred to another division, so I got lucky again. I'm 3-0 so far on contested speeding tickets.

can you ck with your lawyer frined what's the best excuse to get out of a red light camera tix?

I've sent in my statement of fact indicating that red light camera is a speed trap thus illegal based on CVC40801.

Have not heard back from the court yet... just trying to get ready to fight back in case they reject my reason...

As far as speeding tickets go, this is my strategy:

1.) Wait til you receive your courtesy notice from the courthouse and pay close attention to the due date. Wait til about 1 week before the due date and call the courthouse for a 60-day extension.
2.) Show up at the courthouse after the extension period has expired and schedule a court appearance. This is your first court date where the judge ask you how you plead on the case. Always say, "Not Guilty!" and the judge will give you another court date.
3.) Cross your fingers that the arresting officer doesn't show up on the 2nd court date.

Depending on your location, some courthouses are stumped w/ so much work that they have to schedule you so far out on their calendar. This 2nd ticket I got was cited back in March 2004.

Sorry man, I don't have a lawyer buddy . What you can probably do is ask for proof of the red light violation (i.e. photo showing your car and you behind the wheel.) If you give a good reason (i.e. a friend was driving the car that day or say that isn't you in the photo...)
then you might get your case dismissed. Worse comes to worse, just appear in court to fight your citation if your statement gets overthrown. After all, you are entitled to a retrial.
