It doesn't matter if you were speeding or not. He didn't see you, he hit you. His fault. If you were speeding you could just say you were trying to speed up to get out of the way. Either way, it's still his fault. The dude is an idiot. You don't cause an accident like that slowly backing out of a driveway. Unless you ran a stop sign or a redlight, it's his fault 100%.

In ny they have a law called unsafe backing meaning he would be at fault. See if your state has one and if he wad issued a ticket. Glad you're okay

Sorry to see/hear this op, and people do that all the time in my neighborhood. People tend to look back when they are already in the street.

It looks like he was in a hurry. Knowing this could happen wouldnt that cause you to be a little more cautious driving in that area?

There was something in the news near me and some lady was drunk and was backing up, hit someone and got unsafe backing. Doesn't matter if it's out of the driveway or a parking spot.

make him pay for the lie and go to the hospital.. and sue his *** for medical injuries and pain and suffering, as well as the fact your carfax will now be hurt causing lower value for resale and get that money too!

Maybe not the pain and suffering, but definitely after diminished value. Make his lie hurt his pocket book.

Hopefully the collision isn't deemed a total loss although air bags deploying is not a good sign.

Sorry to say but the car looks toast. Airbags blown, frame possibly bent where the crash bar mounts, obviously door, bumper, side skirt, fender, wheel... That's going to be one hefty repair and considering how cheap DE Z's go for nowadays, insurance will probably total it.

The airbags alone will be a big factor and if there is any frame damage it's done. The track wheels alone are worth money lol I would buy it back and part it out
