Default Help with a ticket...

I thought about searching, but felt these ticket issues are different each depending on its situation, so I just decided to make my own.

Earlier tonight I just received my first ticket, speeding and exhaust. This happened about 9:15pm Wednesday night in Irvine, with little traffic. I was driving a bit faster than normal, and there was some van on the side of the street trying to do some weird u-turn on the wrong side of the street. I took off a bit faster when the light turned green to potentially avoid him, and to just get ahead of traffic. I guess the officer was somewhere behind me and he clocked me going 65 in a 55. I wasn't paying attention to my speedo, but that's what the officer said. I didn't admit guilt to anything. He also cited me for my exhaust, (HKS Hi-Power) to which I politely educated him that it's CA legal, considering it doesn't effect emissions, and it is below 95db in noise level. He just told me the referee or whoever inspects my car on that date will decide on that. I didn't feel like arguing, so I just took the ticket and the officer left. He wasn't exactly being a dick, but definitely wasn't a cool cop either.

So both of my citations, one for speeding, and the other for exhaust, are circled as I (Infraction), and both are marked as non-correctable violations. This is my first ticket, so I've really no clue what to do. I'm not going to sit here blaming the cop, since if I was speeding, even though it was 10 mph over, it's still my fault. But I'm going to see what I can do to get the exhaust thing taken off I guess. It could have been worse, I had no front plate, and front side window tints that he didn't check for. My court date is 6/20, and he said I can do a number of things, like appear on court, request traffic school, or fight the ticket. What should I do?

request traffic school for speeding. im not sure about the exhaust though..

its correctable dood. take it off and take your car to a chp office and get the ticket signed off. then slap it back on -D. as far as the speeding http://www.ticketassassin.com/

+1 but for the speeding go to traffic 101 .com i think i did it in 1 day online for me and my dad.

Well on the ticket, both the speeding and exhaust violation are marked as non-correctable. I've heard from a friend who got an exhaust ticket a while back, that the ref told him that exhaust tickets are no longer fix-it tickets. This is just what I heard from him, so I'm not sure. But in any case, the HKS Hi-Power is legal in CA. It doesn't effect emissions, and the sound level (at least the exhaust by itself, with no other mods, like me) is way below 95db. It's a pretty quiet exhaust. I shouldn't have to take it off or do anything to my exhaust, which is what I was trying to explain to the officer.

i got mine signed off monday after i took it off but i agree if u dont have any other mods it should meet the noise level. u can take it in to the ref to get it signed off but if it doesnt work take it to a chp office

Hmm, so I guess I can do that about my exhaust, but will they do a visual of my whole car when I'm there? Say I go in to have them inspect that my exhaust meets CA laws, will they look at my window tint and also cite me for no front plate?

I got a ticket in newport today too.

80 in a 65 on the ticket....

actually doing 85, so I didn't give him ****, but I get the feeling he didn't even clock me. :O

yes. put ure front plate on. as far as tint i woud just roll down my windows and hope they dont ask to roll it up. if they do they wont cite you for it but they will tell u to come back after the tint is off to correct the exhaust

Great. This sucks. You saw my body kit right Danny? I have the same FRP Nismo V1 front as you had. How should I go about putting a front plate on? I obviously want an option where I don't have to drill anything and can take off as soon as I get home. Is this even worth the trouble? I don't want to remove my front tints either. My friend said the exhaust ticket was something like $125 bucks, and that he just paid it, and didn't have to get it inspected or anything like that.

exhaust is like a 300 dollar fine. as far as the front plate i used an L Brace from home depot and double sided taped it when i had my v1 front. im getting my car back tomarrow from dtm after my new v1 front is painted and im gonna do the same. i'll be in irvine tomarrow nit at like 8pm if you wanna take a look at what i did. hit me up

Hey sno, what vehicle code section did he write you up for? Was it for "excessive noise" or "modified exhaust"? Also, what police dept. wrote you up?

Sno,

For the speeding ticket, opt for the traffic school. Take the home test or whatever. As far as your exhaust, go to any police station and let them know that you have a ticket that needs to be signed off. I would absolutely NOT take it to CHP because they will be looking for "other things" to ding you on. Irvine PD should be able to sign off on the ticket. I would not remove the exhaust. If the exhaust is within legal operating parameters, leave it on, but be prepared to prove that it falls within those parameters. If all else fails and the local PD will not sign, take it to court. If no law has been broken with the exhaust, it will get dismissed.

if the exhaust ticket is within the limit i know hks has their certificate...if you don;t have one you can send them your receipt and they will get one to you..this should be enough to get the exahsut ticket dismissed.

Irvine PD officer wrote me up, and I'm a resident of the city of Irvine. The code he wrote me up for the exhaust is 27151CVC. Not sure if this is excessive noise or modified exhaust. Isn't it the same thing? When he told me he cited me for exhaust, and I told him it's legal, he said "it's been altered". That's when I politely educated him on exhaust laws and regulations in CA that he should go home and study. He just told me to take it up to the ref or whoever does inspections.

So is there any place I can go to get this darn exhaust ticket signed off without having to put on a front plate and remove my front tints? I agree the CHP is the last place I would go to. Thanks for all the help by the way guys.


And gqong, I didn't know HKS gives you a certificate when you purchase their exhaust. I bought my exhaust through my shop which received it and installed it on my car for me, so I didn't keep anything it came with like box, instructions, etc. All I know is that the HKS Hi-Power meets all of the CA regulations, being 1) is a catback exhaust and I have no other mods other than the exhaust, so it does not effect emissions whatsoever. And 2) The sound level is far below the 95 decibel limit.

You can go to CHP or police station or sheriff stations for the exhaust. When you are there, they cannot give you a ticket for something else since you came there on your own, this is supposedly entrapment if they do. As far as speeding goes, just depends if you want to fight it or not. I'd suggest getting as many extensions as the court allows then fighting via written declaration.

The coolest thing to do is go to HKS website, grab the "CARB certification" paperwork and leave it in your glove box with your registration and stuff.

Also, I got a ticket in SEPTEMBER and don't have court until 14 June. If you want to delay the hell out of it, the process is as follows: 1) request the automatic extension; 2) before the time runs out on that, call and extend again; 3) when they won't let you extend anymore agree to set a trial date but do it as far in the future as possible; 4) you might then call in and say the dates they gave you won't work and try to get a date further in the future; 5) wait until the day after (seriously, one day after) and then call in and say you have to reschedule (check your area to make sure this is how they do it, in LA it is); 6) set the reschedule date for as far in advance as possible; 7) call in and try to reschedule that (it might not work after the first time, I have to see when it gets closer to the 14th).

Also, I'd probably take traffic school and fight the exhaust thing. Go in with the paperwork and pictures of the exhaust.

That sounds more appealing. Thanks. I just got off the phone with the Irvine PD. I explained to the secretary that my exhaust violation I received last night was clearly marked as a NON-correctable violation. She told me that most of the time the officers mark those as correctable violations, but didn't know why he cited mine as non correctable. She gave me the officer's voicemail number if I wanted to speak to him about that. She said if it's a non-correctable violation, I am just required to pay the ticket/fine. Should I even bother contacting this officer? I'll fight this exhaust violation in court if I have to. I didn't break any CA exhaust laws. Here is 27151CVC for anyone who hasn't read it yet:
