I got a ticket yesterday for the following:

26708 (A) CVC/TINTED WINDOWS
22350 CVC/BASIC SPEED LAW
21755 CVC/PASSING TO RIGHT UNSAFE

So I was headed west on Live Oak in Arcadia and a car makes a right turn and cuts me off, I was so close that I had to make a lane change to the left. After I made the lane change I accelerated back to a normal rate of speed and made a lane change back to the right to get in front of the guy. Btw, the guy was going really slow after he turned in front of me. Well, after I made the lane change I see a cop on the opposite side of the street facing me and he’s at a dead stop at the light. He sees me pass cuz I’m on a green and turns on the sirens and chases after me. He got me for the 3 infractions above. i'm planning on doing a written trial and if that fails and then a court appearance.

Here’s my case:
The cop wrote me for speed of 55mph. he was at a dead stop, on the opposite side of the street, he was headed somewhere, not posted there. There was no radar or laser or anything used, this was his estimate.
Passing to the right unsafe, I’m not sure how to argue this one, but I was well over 2-3 car lengths in front of the guy who cut me off to make a lane change, but again, the cop probably got a bad angle of how I passed.
For tinted windows, it’s just a fix it ticket right?

any advice would be awesome. i'm also wondering how much i have to pay upfront before my court day. dont tell me to hire a lawyer either, i'm broke.

 

tints is just a fixed ticket. as soon as u get the ticket in the mail then go fight it. gl

I would fight it.

 

ticket for tint will be a fix it ticket. as far as the rest you have GREAT scene pics/maps and diagrams for the case. If you go to court to fight it with that much information you should have a good chance to get it wiped away.

I will say that I went to court once with scene photos and diagrams and the judge actually took the time to review them in court and then found me not at fault for my ticket. It CAN work for you and you have a lot of good information. A picture is worth a thousand words. Good luck!

 

I thought PASSING TO RIGHT UNSAFE was when you passed someone using the lane on their right? I know that's an infraction but that's not the case here. Unless I'm wrong about it's definition, you may be able to get that one thrown out.

As for the speeding, if there was no radar used your rate of speed would have appeared to be faster than the flow if the guy in front of you slowed down. It probably looked like you bolted if that guy hit his brakes when you were passing.


edit: Yeah, I was right:

21755 = "Passing on right, when unsafe, or on shoulder."

If you were to the LEFT of the other guy, there's no way you can get this.

Man, Well I used to live in Arcadia and I was harassed by cops because of my modded cars with out of stateplates. I do not know how much money you have but I would fight it. The cops there love to ticket modded imports.

 

arcadia cops are straight up dickss. when i was like in 6th grade, my friend and i were walking to another friends house and a cop stopped us cuhz we were coincidently both wearing all black and he said we fit a gangsters profile -_-.

but good luck with your ticket. really looks like you can win if you fight it.

This unsafe lane change, did you signal while changing from one lane to another? I see alot of people just moving from one lane to another without signaling. And that would be a unsafe lane change.
You should be able to fight this ticket, and the tint be a fix it ticket.

 

Sorry, I don't. I just Googled. There are some nice legal sites as well as State sites with explanations of the infractions. Just poke around...

I think you've got a really good chance of beating this stuff. All but the Tint...which is just a fix-me.
