Was driving home (Vegas) from LA. Mind you, I have Nevada LP's. Highway Patrol pulled me over for 85+, and there was my first ticket . Without knowing, I probably was not driving that fast, but I can not be too sure. I was speeding, yes, but 85+ sounds a bit ridic. I wouldnt mind paying the ticket (obviously) but atleast if my speed was correct....

I am guessing that on his part it was an assumption. Did he have to tell me that he paced me, or did I have to ask? Or is there proof of that on the ticket? I actually live out here in San Dimas, and I'm probably going to drive to Victorville for court, but ya...any help.

maybe you shouldn't have been speeding in the first place.

 

I would invest in a radar detector. I know he said he paced you, but at least will help from the radar guns.

thanks for your words of wisdom, that really wasnt the point. obviously, i should not have been speeding. i'm not trying to get out of the ticket (read carefully) i want it reduced to the correct speed. thanks for your wise and helpful words tho, it really helped.

Anyways, I have read that the most accurate way to get ticketed on a certain speed is by radar or laser. If you take it to court, you have the right to ask for the calibration records of the equipment. If the equipment hasn't been calibrated and up to date, the tickets can be thrown out. However, judges will always side with peace officers so if they said they were tailing and matching your speed, it is almost as good as radar, probably.

I have received one speeding ticket and I did some research and found ticketassasin.com. I followed their advice in fighting the ticket through the mail which will give you the opportunity to bring forth any evidence such as pictures, hand drawn diagrams, written testimony from you or witnesses etc etc. This will force the cop to do the same on his end which he/she may or may not do but it is another hurdle the cop has to jump through. In my case, even though I was speeding (just a little, about +5mph) I created an entirely difference scenario where I said my freeway interchange was coming-up, needed to get over but there was a van to my right going the same speed. So I accelerated to get ahead safely, signalled then merged. I also prepared a defense if they asked why I didn't just slow down and I 'created' a car in the diagram coming-up from behind and decalred that it wasn't 'safe' to slow down with on coming traffic.

Either the cop never responded to the request to present his own evidence or my evidence was too well-constructed and a letter was given back to me declaring me not guilty with the voided bail amount included ($190).

I also learned that if you are found guilty through your mail attempt, you have the option for a second trial in person known as a 'trial de novo'. The beauty of this is that you now have a second oppurtunity whereas if you went physically to court first and lost, you are assed-out from the start. More-than-likely, the cop is not going to both do a written testimony THEN show-up in court if you lost through the mail initially. Most cops just don't care that much from what I have been told unless you were someone memorable to them.

So IMO, you have two options: 1.) Declare yourself guilty, and pay the fine or 2.) Go to ticketassasin.com, research, fight through the mail and hope all ends well.

I believe in Cali that if you fight a ticket and lose, you are almost guaranteed to lose your option to attend traffic school however this is based ultimately on the judge's / clerk's subjective attitude and other things may play into the decision like if this is your first ticket etc etc.

No problem. Depending on your situation, drawing out a simple but thorough diagram helps.

Be careful about 'constructing scenarios' as the cop may have had a camera taping the whole thing.

Another option is to hire a lawyer so they can reduce the sentence.

Ultimately, you may end-up spending more coin considering the lawyer fee's (hundreds) but the lawyer may be able to keep points off of your record which will save you money over the next few years.

because i am a resident of nevada (living in california). i am not "legally" a resident of this state. anyways, i believe i do not get points for speeding, not completely sure. they just require me to pay the fine...still looking that one up tho, but when i was talking to the cop when i got pulled over, he was saying i can not go to traffic school and what not because i was out of town. he said there was no point, but like i said, im still looking that up.

 

OP, that sucks. Precisely why I never take the Z when I go to Vegas. Cheap rental Chrysler 300 can barely get to 70mph.

I've been passed by people doing 100+mph on the 15, what you were doing IMHO wasn't even excessive.

 

+1 on never take my Z to Vegas. I was in a crappy Neon from Enterprise when I get pulled over

That's exactly what you want it to be. The length of time it takes actually benefits you rather than the cop.

 

smart move, it saves miles. on top of that, you wont get the urge to go 100 on the 10miles straight aways.

I'm just sick of seeing posts of people saying "i got a speeding ticket help me" About driving school, I got a ticket in AZ while a resisdent in CA and he told me just to do an online one.

 

And you are completely entitled to your opinion, we all agree.
