I was driving down the street, and a dead branch from a PALM tree fell and it shattered my windshield. My detectable from my insurance is $500 but windshield cost about $150. Has anyone ever made a CLAIM against the CITY? im not sure what to do at this point, i shouldn't be the one to pay for the city's lack of maintenance. I mean, What if that branch hit someone that was walking on the side walk.

is the city supposed to have the tree's trimmed and so on?
if the city is responsible for it, you will need a copy of a police report, pictures of the location as well as the damage, and a total price for everything fixed.
contact your local city hall and get in touch with the city controller or solicitor (different cities use different terms for these guys and what they do) and tell them what happened and how to go about getting paid.

If your windshield has been cracked or broken so that it needs repaired or replaced than you should make a claim through the comprehensive portion of your auto insurance policy. Even if you do not live in FL, MA, SC or KY you can always ask your insurance carrier if they can waive the deductible for a windshield claim. Some insurance companies will waive the deductible for windshield repairs or replacements if their underwriting guidelines allow them to so.

Get as much backup as possible if this is the route you would like to take.

most cities have the same responsibilities - trees are one of them.
Your best bet is to look in your local salvage yards. It might be more trouble than it's worth to go after the city just for $150. That could set you back weeks/months. Our tax dollars pay for Monday morning doughnuts for the local highway patrol (which unfortunately is priority to your windshield). Hope everything works out.

Not sure if this is the case in california, but trees in New York City are primarily maintained by the parks department. If the tree was not healthy, you may have a case.
But yeah, save yourself the trouble and just pay for it if you haven't already.

we got some shops here in Rowland on Valley blvd. dirt cheap to get windows replaced. You are gonna take forever with the city. pretty sure you don't want to drive with a cracked one. if anything, fix it, research what people said, see if the city can reimburse. but not likely

My car scrapes every time I go down a driveway but although anyone can sue for anything these days. Try contacting the city, if you are hard pressed about it and they do nothing, they consider the cost of a small claims court/time involved if that was the next step. Like one person said, seemed worth it to suck it up at the cost of the windshield.
