Default Got Beat Up this Weekend

Summary: I got beat up at gaslamp for my food by two guys who just wanted to pick on someone half their size. The police officers convinced me not to press charges but nearly 48 hours later and now my body is in pain and hurting all over. My friend has cuts and bruises everywhere including his head/face. I have one bump on my head and a couple of bruises but can barely turn my head because my neck hurts and my back hurts.

Long Version: hey everyone, this past weekend i went to gaslamp san diego with a couple of friends. Near the end of the night I stopped by one of the pizza spots and got an entire pizza for a couple of us since we left a bit early and the rest of the guys still wanted to continue their night. I was waiting outside of a 7-eleven for my friend on 5th and market i believe when this black guy and hispanic guy approached me after being denied some pizza by the guy next to me.

They asked me for a slice of pizza or if they could purchase a slice of pizza off of me and I politely answered sorry man, i have a couple of my friends coming and its for them as well. My friend next to me who is (5 ft 3) says the same thing. This black guy who is 6 ft 4 if not taller and 250 lbsif not heavier ((if you've watched the blindside thats his size) with his hispanic friend snatches the taquitos in my friends hands as he was eating it and starts to eat it. my friend goes "what the heck man" and whaaaaaam! this guy just punches him. The two of them punch us for a bit then walk away, then the hispanic guy comes back and the two of them start punching us again. Again they walk away but come right back and at this point people around us jump in between us but they would not stop until we were both on the ground. Mind you I'm just 5 ft 9'' 150 lbs and the hispanic guy was my size. The african american outsized us both. Pretty much they just took our food and beat us down. Each time they came at us we told them we don't want any trouble they have already taken our food and we don't want to fight and we'll just walk away. This happened in front of hundreds of people.

After we were down on the ground they took off running and I got back up and ran after them and waved down 4 officers on their bikes. they cuffed him. After going back and forth with the officers they convinced me not to press charges. I even asked the officers if they would allow me to call my attorney to see what is the best option. They said its not worth it to call your attorney, you'll just be pissing them off. They convinced me pressing charges would just waste my time and nothing would happen to him. WTF WAS I THINKING! I'm still in so much pain. My back hurts and my neck hurts today and my friend has cuts and bruises all over his face. I was thinking of pressing charges but don't know what other options i have.

I plan on making some calls tomorrow since I have not had time today. Please give me some advice. My body is aching. I'm also very upset with the SD police department in how they convinced me to let this guy go and they did not want to wait around for me to think about it and they needed a decision immediately.

OR IF ANYONE HAS VIDEO OF IT PLEASE DIRECT ME TO IT. I KNOW THAT WHEN I GOT TO MY FEET AND CHASED THEM A COUPLE OF PEOPLE HAD THEIR PHONES OUT AND WERE TAPING IT.

Hope it was great pizza. Not worth getting beat up for Domino's. Take some Tylenol and call it a day.

Me being me and how I was raised. I wouldnt go to the police.
Id take matters into my own hands. and do worse upon to not necessarily them. but to their belongings.

or you pay somebody to do it for you.

I'd recommend pressing charges, if not for the remedies for infliction of bodily harm and theft then for the fact of causing them some pain in return.

i didn't get to eat the pizza if you read the story. i ended up on the ground and i gave up my food to them because i didn't want any trouble yet they still came at us.

yeah, i've been checking. back a couple of years it would have been something that i would have considered but now i'm older with a career and its just not worth it. i'd rather hurt their wallets or time even if it costs me my own $.

yeah this is what i am considering doing but some people have told me it is not worth my time and money. but after looking at my friends face and see all his bruises and bumps on his forehead, it makes me want to do this even more.

This is pretty outrageous behavior on the part of the police. Can’t speak for San Diego, but in more civilized venues a crime such as this is considered an offence against the state. No proper policeman, having a crime happen right under his nose and with the perpetrator in hand, would feel his first choice should be to just blow it off.

Now is it possible that this cop has seen this type of situation many times before. Was he subtly telling you that these guys would probably come after you for retaliation if they were arrested/charged? Maybe the local judges are super soft on crime. You might end up taking time off work to sit in court all day for the case to come up (maybe several times) to find after a year or two that the charges just fizzle away. Your attorney will most likely have somebody in his office, (or a relationship with someone) who is a criminal lawyer. Do seek their advice on the best way for you to proceed with this. If they suggest the cop was giving you prudent advice, then so be it, and drop it. However, if you want to pursue it, pay the fee to have the lawyer go above the reluctant officer’s head demanding charges be laid. The lawyer will assure that your best interests are protected as much as possible in the way this is handled.

If it was so easy to get away with something like that then it's better to just pay a hitman or something and take those btards down or maybe just beat them up really bad.

@OP, just take selfie pics of yourselves as proofs in case you want to go ahead and press charges against those lowlifes.

my guess is younger guys. no class.

i would go back there and see them again. if they get away with it once then they will surely be back. bring an asp this time and some pepper spray if you think you cant take them with your hands. be prepared. when i was younger i had a similar issue happen to me. i didnt feel better about it until i returned the favor.

im guessing you havent been in many fights. the next time it wont hurt so bad. it gets better and easier.

I'd demand names and then follow there days and when they are alone.. Lets just say they won't be eating pizza for ALONG time!

That sucks OP. Gas lamp USED to be a nice area. Im curious as to why a police officer would advise you NOT to press charges, that's a little odd. Really odd honestly.

Last time these two dudes (one like 6ft 5in) mouthin off to random people. I didnt care, he's drunk. But he thought he was a tough guy, flappin his gums.

Then he said something to my friend...still didn't really care and told HIS friends to calm him down or dude will catch elbows. Then he said something to my GF...Let's just say he got laid out like a blanket...him and his b!tch *** friends.

Stories like this make me thankful that I'm 6,3 and 205lbs.

Advice for men of small stature when going up against a larger opponent.

Go for the throat and eyes. A quick punch to the throat and finger jab to the eyes can bring your larger opponent to his knees and then you can pummel his face till you break your knuckles if you want.

I could think of a bunch of things I would have done in that situation. Each one would leave those assailants bleeding profusely on the floor. BTW you should have been on the defensive as soon as those thugs walked up on you.

If your as small as you say you are I would have grabbed a butter knife and jabbed it in one of their throats.

Don't be a *****, just because you may look like one. Show why you shouldn't mess with people you don't know. My 02.

Hopefully this situation has made you harder and not more of a *****.

Get angry, don't get scared! GL on the recovery OP.

I went to the Gaslamp about two years ago and it seemed like a cool place/area.. It's unfortunate you had this experience. Go after them and next time, listen to your gut.

Happened to my friends many years ago, after watching a Lakers game at the Staple Center they went to some local place to eat. Couple of guys came up grabbed their partially eaten burgers out of their hands and started eating it. Fight ensued.

Time to get a gym membership. And lol @ some of these guys saying to go back there and raise hell. If those guys are willing to steal someone's half eaten taquito, I don't think they have much to lose. If you go down to their level, they'll go lower. Its easy to sound tough on the internet, different story when you are there LIVE. Talk to your attorney, and heed his advice. I'm sure he/she's had more experience than most of us on here. BTW, don't go anywhere late at night with backup if your backup is 5'3". Just a heads up.

you should call the sd police dept and see if there is an incident report. explain your situation and that you are now changing your mind and willing to press charges. this is all if the officers did their job and at least filled out an incident report. they probably didn't want to take the time to arrest the guys for assault because then they couldn't ogle the drunk pieces of *** coming out of the bars.

I wouldnt press charges. people like this are usually creatures of habit and will return to same spot / live nearby.

I would suggest to find out who they are, their routine and then make their lives miserable for a few months till you get bored.

yeah, gaslamp district is one of those streets that has a huge nightlife with bars lined up down for a mile i would say. my friend at the time says they are probably immune to it and for them it is just another scuffle.

yeah actually it was my first one and i definitely wasn't ready for it as he just turned around and started swinging. i start my first krav maga class tonight.

hopefully i learn some things from krav maga. the thing was when this happened i blocked his first swing at me but i didn't strike him even though i had a clear path with my right hand to his face. the only thing in my mind was i can go to jail if i injure this guy even though its self defense. i know this sounds silly but i've seen/heard people sued even though they were on the defense. i have a career and i love it and i didin't want to risk it as i thought they would leave. i know it makes me sound like an IDIOT OR MORON.

seriously i am getting really angry and even though my body is aching i'm going to start my first krav maga class today. hopefully i learn some things.

I know we were actually there with like 10 other guys but 3 of us called it a night earlier so we were maybe 2 blocks down just grabbing some pizza and food for everyone. we wouldn't purchasing pizza would turn out to be such chaos.

i do have an incident report and i made some calls and found out i can still press charges if i want to.
