Default So I finally Got a Ticket... Quick Question Inside.

I'm asking this here because you guys have a lot of experice with these things and there are a few lawyers in the fourms. After 10 years of driving I finally got a Ticket. I was for something stupid like a no turn on red.

I was lost in a City that I didnt know much about. I was just following the lead of the guy driving infront of me. He made a full stop and turned right and I did the same so the cop pulled us both over. Btw, it was in a plain looking 2x4 Tacoma and it wasnt in the Z. Oh and this is Albert not Ben.

The cop said since youre not from this city and youre not aware of the signs I'd let you slip but the other guy would complain. So I have to give you this ticket.

Anyways the reason Im asking is my Court Date on the Ticket said 5/6 and I called the Clerk to ask where my courtesy notice was. She said the Ticket was never filed.

Is there a chance that the cop never gave the Ticket to the Court? So what do I do now?

Any advice would be much appreciated.

I take that to mean you're in the clear. The prudent thing to do would be to call the Clerk again and ask if that is in fact the case.

After a cop gives you ticket, they must file it. To cancel a ticket takes an act of God, this is so that departments can avoid corruption and takes "fixing tickets" out of the equation. Usually the Chief of Police has to sign off on a cancelation. I would say your ticket is still valid and I would look into it to avoid a warrent.

When it's filed is up to the cop although I would assume there is some kind of time limit. I had the exact same thing happen to me last november. I never did receive a courtesy notice...only through calls to the court did I find out that my due date had been extended. The ticket also mentioned a court date that fell on a sunday. Either way, it sucked.

the same thing happened to me once. what ever court date is on your ticket go and show them your ticket when they go to look it up it won't show up then they make you sign something and give you proof that you showed up. at that point just wait it out and you may be in the clear. the CHP that ticketed me never filed the ticket and/or lost it.

The court clerk said this happens sometimes but to be safe always save your paper work sometimes they file them late and if they do your still responsible. it's been over a year for me and i still don't have it on my record. LUCKY ME!!!

Oh yeah ... don't just call go to the court house and GET the PROOF you showed up

This is bull. He just said that to make you feel better. He wanted to give you the ticket.

I've heard of situations like this where more than one car is pulled over. What the cop would do to the car with just a warning is to tell him to stay put while he writes tickets for the other drivers. Once the last person gets his/her ticket, then you'd get to leave. That way, the other drivers would never know and can't complain.

I just checked the Ventura County Courts Website and I typed my Citation Number and viola it was there. My Court date was bumped to 5/20 and the fine was $144.00

Damn $144.00 for a no turn on red?

Thanks, I passed by that Intersection again and there were 4 separate signs on the that Intersection. All saying NO RIGHT TURN ON RED.

I think theres no way out of this one
