Default The Worst Day Of My Life

So I took my 2006 silverstone 350z to Baker Jackson Nissan-South in Houston, TX to get its FIRST oil change, which is free. Well I took it there Saturday and my service advisor said that there were a lot of cars ahead of me and if I could leave it there til Monday so I said sure, no problem. Before I left I made sure to disarm my Clifford RSX 3.5 alarm w/push start. I told the advisor just unlock and lock...don't press any other buttons. Well I got a call this morning (monday) from Baker Jackson stating "your car just sideswiped 2 other cars"...I was like WHAT THE ****!!!!!!!!!!!!!!!!!!!!! I said I told you not to press any other buttons but lock and unlock. Theres no way the car would start unless you press the push start button twice. So someone tell me if you think they did it on purpose or they did it unintenionally, reason im asking is because the gm thats been there for "3" years states he's never seen an alarm like this. I told him I don't care if you've spotted bin laden, thats my toy and nobody but me should be messing around with the alarm. He said that he needs to call the stereo shop that installed my alarm and ask them who would be responsible, i told him that their not going to fix it because if your car is stick they make you sign a waiver. Now I understand that if I push started it and it launched, I would take the blame but since the dealer did it THEY SHOULD BE THE ONES PAYING. I sware to god they better have my ride fixed or else im gonna go there with my lawyers, sue them, find the technician who push started it...AND LYNCH HIM!!!!!!!

Personally I think you'll be SOL on this one bro. Auto start on a manual transmission is never a good. BTW, Baker Jackson South is a horrible dealership(service dept.). There are a few threads that have listed bad experiences with this dealership.

yeah u gonna be SOL on it b/c of the remote start. i could have gotten it for that reason. most dealership never listen. its always at ur own risk kind of thing. best of luck

Why did you leave your car at the dealership overnight for 2 days!! I get paranoid when I park at HEB to do my groceries!! Hope everything turns out okay. Vent your anger out on the bad/good dealership thread!!

That sucks man. I think they'll be responsible. They cause the accident. Good luck. Try getting to an agreement by talking to them if not just hire a lawyer and own the dealer. Good luck.

when ive had remote start on manual cars, i NEVER leave it in gear. They probably wont wanna take responsibility for it.

Well let me first say that I despise the word lynch in ANY form or reference. It has no place in the American language and is in fact a complete and utter hateful and evil act.
Now then....... I too would be extremely upset and even contemplate woopin some azz (even though legally I know better). I am interested to see how you come out of this situation becuase I remember a installer friend of mine telling me about a customer of his in a similar situation involving a valet service. The owners insurance ended up paying for damages to a vehicle it struck when it remotely started in gear.

I think that since there is a sensor for the clutch on standard transmissions, that Clifford would be smart enough to sense if the car is in gear or not. I can think of a few ways using simple switches that would work.

NOW I know i should have just give them the KEY!!! But man I didn't know they would be careless and mess around with my remote. I even told the guy I have push start and all you need to mess with is lock/unlock but I guess one of the techs thought otherwise. I dont know what to do...they said their looking into it and I gave my lawyer a call and he said he'll see what he can do. I just hope nothing comes out of my pocket.

I've been getting service from that dealership for a long time and they've been really good to me. I wasn't impressed by their service manager (sanchez), but the rest of the crew is decent. And I have tried almost every other nissan dealer in houston...so I'd like to know which dealership is better? Sucks what happened to your car...I would be pissed...but I think almost any dealership would try to pin the blame on you. I know you were careful to tell the guy about the remote start...but I would be scared as hell to entrust them with something like that.

Hope they pick up the tab for your repair....they really should IMHO.

fuc.k trying to get your car fixed you just got the damn thing, now your car's resale value is worth shi.t. You need to tell them to give you another brand new 2006 silverstone Z or your going to sue the pants off them.

HOLY ****! Your kidding me!! THIS EXACT SAME THING HAPPENED TO ME A WEEK AGO! I brought my car in to get the fuel line recall fixed and one of the sevice guys remote started me car and it went down a FEAKIN 20 FOOT EMBANKMENT and hit another employees car! The service manager said he would have everything fixed...problem is when they tried to go throw insurance, the insurance company said it would be partially my fault! So now im waiting on a phone call to see what the SM says. Its stupid though, because I've been going to the same place for almost two years and have never had an issue. The only way you can remote start is if YOU KNOW how to do it. Im guessing one of the guys knew I had the system and tried to show off (hence they told me like 6 employees saw it happen) and it was in gear with the e-brake off. Even if the guy had just left the e-brake on, all it would have done was stall....SO frustrating! Where you at with all this pony?

Sorry to here of your misfourtune. I know of 3 times that this has happen to friends. 1 was a customer 2 were employees. One took off down the hill, and hit one of those phone station thingies (cha-ching). Another ended up in Freemans car stereo show room. The other hit a Dodge ram, and a vw gti parked. All 3 owners were held liable, even though they didnt push the button. I refuse to install remote starts on sticks waver or not. Be glad no one got hurt. Good luck.

this sucks for you man.....if they dont end up payin for ****, i think itd be worth it to kick the guys *** who remote started the car, cuz you basically have to know what youre doin to get it started. and ive never really understood why anyone leaves a car in gear when they turn it off. but good luck with this

Wow, it COULD go back to the place that installed it. I can't believe they would install on a manual transmission. I'm would think the instructions that came with must say "DO NOT DO THIS!"

REgardless of the device, if clear instruction was left to not do something then they should have some liability.
