Default new nissan ecu update software?

I have an 03 z with 91,000 miles, which I have had forever with no problems thus far. The other day I was driving and my car's check engine light came on. So, I went to the nearest auto zone to get it scanned. A P0442 (evap code) was the culprit for my engine light.

I bring my car to Nissan and my car has not received the 03 recall for the evap code but this isn't what triggered the evap code and the system is holding pressure perfectly, Nissan said. So, they tell me that they are aware that the z's ecu will sometimes get confused and throw a evap code. I have no problems with my car other than the shitty *** old ecu software issue.

I get charged a 105 dollars for a new software update on something I feel they should have fixed for free. I even asked them about it and they said they would have covered it if it was a recall but it wasn't. So, let me get this correct I just paid 105 dollars because of Nissan's ecu faulty programming. Why should I be paying on my end. Just resetting the ecu wouldn't have cured this issue either they said and it needed a new software update. What do you guys think of this, end of rant. Seem's pretty shady to me that I have to pay for this.

Should have saved the money towards an Osiris reflash which includes the latest nissan code as well that's what I think

update: I called corporate and complained and they absorbed the 105 dollar tab. I'm good to go now. That was a pretty stupid experience but it worked out in the end. djamps, I would have done that but wasn't sure if it was a issue or not.

Evap on an 03, mine was flashed over the summer and no change, still thru codes once and a while. The rubber elbow on the evap canister was cracked, $1 worth of material and havn't had another evap code.
