Default How many times before its a lemon?

Hey guys, I'm well aware of the CSC problems with our cars and that there is a recall for the 07's, but being the owner of an 08 I can't help but wonder how many times its going to have to happen to me before I don't have to deal with it anymore. First time it occured was at 24k miles clutch pedal would stick to the floor and not come up unless i pulled it back but it still wouldn't engage or disengage so i was basically stuck in 6th on the freeway, took it to dealer and they replaced both the slave cylinder and the transmission both under warranty. Fast forward to today and now at 35k miles same crap yet again clutch pedal stuck to the floor and won't engage or disengage the transmission, so now shes sitting at overnight drop off an hour away. I have the repair order from the first occurence, and I would consider it a safety issue with it happening a second time within such a short period of time. I don't abuse the damn thing, and I maintain it very well I just want this thing off my hands now with all this frustration it has given me. Sorry if it seems like i'm ranting I just need some input from other guys that have been in the same situation. thanks

I beleive it is 5 times for the same issue to be considered a lemon.

thought it was 3 but im pretty sure the law varies state to state, dont think its a federally regulated thing

Correct. In California? Do not know. Contact a lemon law attorney.

3 in Florida.. and I'm pretty sure most states are, Contact Nissan Corp. They'll usually try to get things done..

Thanks guys, I was just frustrated as hell last night when this happened and needed to vent out, i'll try to contact nissan north america today.

so i talked to the stealership, and they said the dealer that replaced the trans and slave last time didn't properly bleed the system? wouldnt this problem have came up way before 10k miles later??

Sounds like they are cops & lying to cover their dealerships a$$. Not that copS eva do ANYTHING that isn't 100% honest & law abiding.

for sure, i'm going to pick it up in a bit, i may take it to a different dealership for a second opinion, this isn't the same dealership that replaced the trans and slave last time so im skeptical of their work. I contacted NNA about a buyback so we shall see what they say, theyre supposed to get back to me within the next day.

While you're at it, please file a complaint with the NHTSA. Nissan won't do anything about these incidents unless enough people complain to the feds.

i filled that out the first time that this happened, should i do it another? So i got the car back and all this dealer said was that they bled the system and test drove with no problems, lazy f*cks. Clutch still feels really light and weak which made me skeptical i'd even make it home, my friend drove his hr with me the entire way back, and when i drove his, the pedal definitely felt more firm than mine. Do i have to wait for it to happen again or what?

**UPDATE**

So I talk to NNA and get a case number regarding the problems with the car, tell them everything that has come up so far and they inform me that i need to get the vehicle inspected at a nearby nissan dealership before we can proceed any further, which is the one i normally go to in case i have problems, the previous dealership that said all that needed to be done was to bleed the clutch was apparently wrong. In fact this time around my dealership informs me that the clutch master cylinder is now going out and that they will have to replace it.

So once i pick the vehicle up i'm wondering what NNA is going to say.
