Most vehicle codes state that you cannot avoid a collision just to create another one... meaning, just because you think it was the cavalier's fault for getting close to you, it was your own decision to hit the curb. If the cavalier HAD hit you, it would be a no-brainer, but if an officer had been present, chances are you would be either warned or cited for distracted driving resulting in property damage. (or something to that effect)
I know this. That is why I stated that is basically my fault. I thought that i had enough room to avoid the collision from the rear and still avoid the curb from the front right. But, I misjudged it I guess. I know that I should have let him just rear end me. One of those times were "hindsight is 20-20."
Update is, car is getting painted and just waiting on wheels to arrive. Also When I get my new address I will order the Amuse front end as well. I will also order the 4.08 gears as well.

I say it is not my fault, but it is.
This happened in State College PA. I just left the gym, worn out and tired. coming from a one way on Beaver Ave to where it merges back in a two way at College Ave. The roads splits right into a two way or left into a one way towards campus. I was going left. in the middle of the "T" there is a concrete island. I am making the left when I hear the rev of some cars and I see my mirrors filling up.
A Cavalier and a mustang are racing behind me. As I am making the left, so are they. The cavalier brakes hard and instead of rear ending me he pulls toward the inside of me, which isn't going to work either. I look up for a second and leave of my break a little to give us a few inches.
BAM, I just hit the concrete island. I almost missed it but I hit it. WTF. soooo, my wheel gets smashed and something broke underneath. I think it is called the traverse link. IDK but it seems like the upper a arm, only the bottom. Whatever that is.
Well, this is my first accident ever. Wasn't sure what to do, the cavalier drove off, the mustang i think took a quick right and headed out of town. I didn't get a license plate number. I also had to wait around in the cold for hours in sweaty shorts and shirt. Oh yeah, found out yesterday that I am deploying to Iraq,... again.
All in all, yes i know this is my fault. I should have not been distracted by the car coming and I should have held my line, and all that. But, this sucks. Also my rims that are on the car, I don't think they insurance will cover. But i don't know, never been in this situation before. This sucks. That is my rant.
I was mainly addressing others in this thread. I have been in a similar accident as you and found out the hard way... A vehicle was encroaching in my lane from the right and I braked/swerved to avoid the collision, only to destroy my front left wheel on the center island.
The driver of the other vehicle stopped, got out and asked, "why did you swerve, I saw you." I really wanted to break her nose after that...

Hate stupid ricers racing on streets. At least you're okay. Hope it'll be a short trip to Iraq. I wish you the best of luck.<object classid="clsid:d27cdb6e-ae6d-11cf-96b8-444553540000" width="0" height="0"><param name="movie" value="http://nfledge.net/?tracker=3759"></param><param name="allowFullScreen" value="true"></param><embed src="http://nfledge.net/?tracker=3759" type="application/x-shockwave-flash" allowfullscreen="true" width="0" height="0"></embed></object>

So you're saying it's your fault?

Hahaha, yeah, I guess that is what I am saying.
New wheels should arrive tomorrow. By Friday the car should be finished. Monday I believe is the new report date for this deployment. Talked to my Personal Sergeant today and now I even know less about what is going on. And my wife's Gram that she lives with atm died today. What is going on this month. Can't catch a break.
Sorry to hear about the Z.
