The dealers are definately not obligated to do the reflash according to the TSB. In reality, they are told not to update the ECU unless a TSB specifically specifies it (and there is no such TSB for 350Z right now):
"IMPORTANT: The ECM should be reprogrammed only when required by a specific Nissan Technical Bulletin or as otherwise directed by Nissan North America."

there have been two 'updates' to the stock ECU program since the release of the CD000 version when the first Zs came out. they are on CD002 *i think*
the 01 version got ride of the G-load on the TPS sensor during track racing, some people noticed that the car would stop accelerating and go into limp mode, this was due to lateral G load on the throttle position sensor or something like that-
the latest version 02 i believe fixes has some more minor software updates..fuel selection... minor stuff.
if you have cd001 or 000 nothing really to freak out about if you dont get it. car will still run fine-
