Because he wasnt contesting speeding... he was contesting the actual speed (96+ mph)... and they didnt know the cop was a no show until the very moment... so i still think he was very LUCKY... esp. coz he's still on student limitations as far as CA. Laws

 

Ok so your cousin says to the judge "sir, i was not doing 96mph". Without the officer present, who in the court room could possibly prove he was doing 96mph??

Unless your cousin said something like "i wasnt doing 96, i was doing 94" (in other words, CONFESSING to the actual speed) then there's no evidence against him.

It's all about being innocent until proven guilty. NOT the other way around!

dertk173, get a lawyer and you'll be fine. Also, I'd like to know how the cop knew you were going 94mph without radar, vascar, pacing etc. You can win this one with a lawyer. Don't plead guilty.
