Default getting justice

some of you may recall my problem I had back in March... where a guy who owns the property next door to me was responsible for $1700 worth of damages to my Z.

the guy is being an a$$ and not owning up to the damages. he ignores me, doesn't return my calls, lies to me, etc.

so.... I created a website with his name

Stepehen Tatro is the guy

www.StephenTatro.com is the website.

I called him to let him know this website was up and running and that I would do all I can to make sure lots of people read it.

If y'all have a spare minute... check it out.... this guy is gonna pay for this.

You do know what libel is, right? Even if everything you posted is absolute truth, you might be looking to add a lawsuit to your woes if this guy is the jerk you say he is...

vermillion, you beat me to it. This is a lawsuit waiting to happen. If I were you, I would direct all of the efforts of this into a lawsuit against him. Take the site down, it is only going to give you trouble.

Just my opinion.

I agree with them....

When the lawsuit times comes you do not want to give the other guy any ammo....

That website can only hurt you in court.

he can't bring this site up in court during the lawsuit. it's irrelevant.

of course he is free to sue me for libel in a separate case, but it's gonna be hard to prove that I published libel IMO

there is no defamation of character only facts

I think if I had any self respect I would have bit the bullet and cut the grass next door before it got to 48" tall. That's just me though...

You seriously need to take down that website. It won't do anything but hurt your case if the judge were to see it.

So, have you tried the "burning bag of dogshit" method to get your point across yet?

I think I'd take that option before I wasted webspace on that dipshit.

And if you cant find a willing and able dog, just order like $300 worth of chinese to his house and watch all the fun from your front stoop.

i feel your pain, N74DV. it's so hard these days, when the law seems to screw the folks who follow it, and protect sh!heads who don't care. i'm down 100% with your anger on this, and in a perfect world, this guy would be shamed publicly for being a drain on society in general. but it doesn't work that way. The PD that told me they couldn't (or wouldn't) do anything to find the guys who tried to break into my car (and caused over $1000 in the process) will bag me with a ticket for 6 over in a heartbeat. The judge that will say you're out of luck will also hammer you for damaging this knucklehead's self esteem. Gotta walk the high road, brother. either that, or make sure whatever you do will never be traced to you.

I consulted with my boss... who is an attorney and he says that my website is not legally slanderous or does not contain libel but he did tell me to be very careful with it.

Even since this morning I have made some changes to it because there were some very fine lines that could have been considered libel.

I'm walking the tightrope with the site, but I feel damn good doing what I'm doing..... having your Z phucked up is a sickening feeling and to have the guy responsible be such an *** about it makes you want to commit an act of violence, but I'm not that type so I do the next best thing.... and I gotta tell ya... it feels damn good throwing this guy a taste of his own medicine.

I'll leave the site up for a while and see what happens.

I'll keep y'all posted with the results.

You are a better man than I. I usually resort to fear and intimidation to resolve my issues.

Well not all the time...but I certainly wouldn't allow any more time to go by before this dick has to pay up. Forget calling him, send an official letter stating that he has until such and such a date to pony up the dough, otherwise, see you in court. I had a similar instance a number of years back when a tire place gouged up my new wheels. I called twice and talked to the manger, all to no avail. A formal letter stating that "my attorney has advised me to allow until ten days from reciept of this notice for a suitable resolution to be reached. If no action is taken by said date, then certain actions will ensue including, but not limited to, litigation,...blah blah blah" You get the point.
