Is a Carpool violation counted as a ding for insurance purposes?

Several CA policemen and others have told me that carpool violations are not counted as a point against your driving record. However, when I tried to get some quotes for new insurance, they counted it. They said that DMV has it marked.
Any insights? Anyone know more about this?

Just talked to my auto insurance agent yesterday. He said now ALL claims (fault or not) and all violations are counted and added to a matirx to determine exposure. There are different values placed on each "incident" so a claim for a rock dinged window repacement is different than an at-fault accident but it all goes in to determine insurance rate. Your incident may not be considered a "moving" violation but it is recorded and passed to your insurance company when they get your information.

I just got off the phone with CA DMV.
Carpool violations DO NOT count as a point on your driving record.
I was concerned because the insurance agent that gave me the quote told me I had a point from a carpool violation.
What a jackass! Trying to rip me off on higher premiums!

Here is an update on the issue.
I called about 4 different insurance companies, and they all count the carpool violation as a point!
They do this for the insurance purposes, even though DMV does not count it against my driving record. One agent told me that this is what ALL insurance companies do. Even though it does not count against me as a point for purposes like losing my license, the insurance still counts it.
IS THAT BS OR WHAT!!!

My wife had an accident once and cop filled a report without even talking to her (she was quite in shock). Cop stated that it was her fault. Later we proved in court that she wasn't at fault, and cop filled a report completely based on other drivers story... No DMV record, no points... Guess what, insurance company chose to use original police report to get our deductible, and every insurance company since then sees at-fault accident on our record (not DMV records, but their own insurance records). Even after I show court rooling that original report was not correct. Greedy bustards.
I was thinking about suing, but then decided I don't have much chanses against big guys.

In CA. a carpool IS a moving violation, in most other states it varies but most of the time it is not considered a moving violation
according to the DMV. Most insurance agencies
DO include a carpool infraction as a moving violation but just as
according to THEIR rate assessment. If you simply aren't wearing a seatbelt the ins. companies won't assess any penalty. You can
break all the glass you want to as this comes under "road hazzard" and your rate won't increase or insurance points assessed. My wife broke out 3 windows in our last minivan within 2 years beacause she locked her keys in and our rate didn't go up. Still I duck taped an extra key under the bumper so
I wouldn't have to keep replacing glass and in the end running everyone's rates up.
