My totaled Z - What do I do now?
For those saying I don't need to get a lawyer.....or I should be nicer to the insurance company.

My reason for getting a lawyer is to get is what is owed, however a 3 month wait to get the same car does not sit well with me after my 6 month wait for my now wrecked pre-order.
Someone - namely the insurance company - has to make me happy and right now I am not feeling it. What would make me happy to have the car I had on saturday morning back in my f#$#ing garage.

I understand perfectly. Hell, I've still yet to receive my Z that I ordered back in March. And I didn't tell you to not get a lawyer nor did I say to be nicer to the insurance company. Just posting some information and trying to answer a lot of misconceptions and misinformation that is out there.
There are situations where I would definitely advise people that they SHOULD retain a lawyer. Those generally involve serious injuries with long term repercussions.
I honestly do feel terrible about what happened to you. I would be insane if this had happened to me. Some people just go off the deep end without knowing what they are talking about. Chances are, you will never even need to file a suit, even with an attorney representing you. The vast majority of claims are settled without suit being filed.
Of course, since we insurance folks are so evil, maybe it would be better if there was no insurance involved. Of course, then you would have to try to get the money out of the other driver, himself (if he had it) and that would almost certainly require a lawsuit.
As for me, I hope that the other guy's insurance carrier, whoever they are, shoot straight with you from the start and take care of all of your damages as quickly and fairly as possible. I hope there is another similar vehicle available to you as early as possible and that it gives you as much joy as all of us here on this forum expect to get out of ours.
But most of all, I hope that your injuries heal quickly and completely so that you can put this whole incident behind you.

Glad to see you made a smart decision. You have to protect yourself and your family for sure. I'm sure there are honest insurance people out there. I have a great relationship with mine here. But....

And if I might add, the adjustors have a damn good idea what your compensation will be when this is over, and I'll bet MY car that they won't offer that figure up front. You'll have to beat them out of it if they offer it at all. Who needs that kind of stress??? They know you want a car, NOW. And they have no reason to pay any more than they can get away with. And they also realize that the longer they can keep you hanging, the lower the settlement becomes. And one more point, they also know that when you have counsel, you mean business. There's no way for the consumer to know how much to "settle" for, and that's why they want to keep you away from the lawyers. They know the figures, we don't. They're hoping to gey away as cheap as possible no doubt.
There're pros at this, I'm glad you just leveled the playing field.

I have to say I recently had a claim with SF and it was easily the SMOOTHEST ins. claim I've ever been involved with. They came out to check my vehicle quickly, and when I wanted the $$$ to go to me not the body shop (I wanted to get some custom parts instead of factory-replacement) they immediately agreed - in fact, the adjuster had an office in the back of her van and printed me a check on the spot in my driveway! When the shop that did the work found some hidden damage later into it, they OK'd it right away and it didn't hold up work on my truck even 1 day.
Now I *have* had bad experiences, both with a local insurer that refused to pay for their client running into my car (still fighting that B.S. - Gateway Ins. SUCKS!) and with a major national company who proved damn near impossible to deal with on another wreck that wasn't my fault (American Family)
But so far, State Farm is the best/most agreeable in my experience
i'm really sorry to hear that but i'd like to make it up to you. would you be willing to sell your burnt orange seats. from the start i wanted chrome silver with burnt orange but that was not an option. so i had to settle with frost leather. but i would love to buy your seats. let me know on a price.

I'm not sure of everything you require compensation wise, nor do I know all the details of any proposed compensations which you feel are unacceptable...but: If you don't want to rack up large $'s in attny's fees, you may want to consider mediating your case or agreeing to an arbitration. Many large insurance companies allow this as common practice, and you can represent yourself quite easily. Agree on a neutral you feel will understand your positions, and he/she will not play favorites. You can express each of your arguments and the neutral will take them under advisement and decide what is the "right" thing to do. If you are looking to be fairly compensated and can susinctly express each of your concerns and demands, you could have your situation resolved fairly in no time. If you agree to this type of settlement just be smart and tell the insurance company you will only agree to it if they accept to pay any and all fees incurred for the process. Short note: if you do a mediation, no matter the course of the conference nothing can be mandated...if both parties come to an impass, there is no net result....you can try another day, or pursue damages through traditional court system. If you arbitrate, whatever the neutral decides is fair and stipulates is what both parties are bound to.
