Arrow My totaled Z - What do I do now?

I already know that I am going to need to get medical bills, loss wages, and compensation for the actual cost of my car from the insurance company. I am not at fault in this wreck and the insurance company I refer to is not mine but the gentleman who pulled out in front of me.

Several points with associated questions are listed below. Post your opinions on any or all of the questions listed below. Please list the question with your answer if you don't mind, as I took a pretty good blow to the head.


1)2003 Nissan 350z - Touring/6-speed | Le Mans Sunset/Burnt Orange Leather | Navigation, Aero, Mats, Plates, Guards, Bags, that combination will probably be hard to find. I paid MSRP for my car. What If I can not find a replacement for the same amount of money? Are our cars worth more than MSRP at this point because they are so hot and hard to find? Should I be compensated for this discrepancy by the Insurance Company?

2)My second question is should I try and get something for the fact that I waited 6 months for this car and had all the associated pre-order information that would have made the car worth more as the years go by. How much do you think this would be worth? Should I insists that I get a car with a VIN number under 6,500 (the amount of US pre-orders)? Admittedly it would be hard to do.

I will be contacting the insurance company and possibly a lawyer this morning. Thanks for your opinion and support over the last couple of days, it really means a lot.

I dont think you will be compensated from the insurance for the cost of replacement (MSRP debate) however you have a really good case to get the compensation elsewhere. Insurance companies will not give you money they dont have to (in this case your car) , but in your case (time, health, pain) there should be plenty to gain. This being said, I still would not let them tell you the car depreciated when you drove it off the lot.

Yes, if it affected your life in that way and you have the collection that most of us have and can somehow show them your time and effort that went in to this purchase. I think the best you will get is their sympathy and they may treat you better than most.

Good, I was upset when I heard this happened and I know this would be my main concern. You bought peace of mind when you ordered the side airbags. It left you with a jumbled piece of mind instead. If Nissan was the company I think they are, you will get a shiny new Lemans Sunset sooner than you will think, it will not be free but I bet they dont drop the ball on a quick delivery if you get another!

I would surmise that it will be VERY difficult (but not impossible) to find an exact match which has no buyer. NNA may be able to help (I'm fairly sure someone within NNA has seen your pictures by now, and it would be a nice gesture if they could help you out and do a search of dealerships to see who might have one for sale). Most dealerships will probably tack on a few grand onto the price, but maybe you'll luck out and find an honest dealership who will sell for MSRP. Blue book pricing is not yet available, and the question of the car's market value is certainly a good one. My guess is that the insurance company will repay for replacement value, which does NOT include dealer juice. I would ask the insurance company about this, but don't hold your breath waiting for extra money to cover the juice.

Just a guess here, but I'm inclined to think that your insurance company will not be interested in how long you waited, etc. They work in a world of numbers published in books. They probably won't be willing to help in a search for a low-VIN car either. Their obligation to you is to repay you (or your loss payee) for the replacement value of the insured car. What you do with the check is up to you.

My recommendation would be to ensure that you'll be getting a check from the insurance company in the near future. Next step would be to inquire with NNA if they can help you locate a match for your LS Touring. If that doesn't work out, then find a decent dealership, explain your story, bring pictures, and place an order for a new one.

I am really sorry to hear about your crash, but glad you are pretty well intact.

I doubt you will be able to find an exact match for your car, but there is no hurt in trying. The car is going to be in high demand, low supply until enough time goes by and the excitement of the new Z fades a little. I am caught up in all that trying to order one from Nissan, but that is another story.

I really doubt your or any other insurance company cares that you got one of the pre-order cars with a low VIN. The car is new and is a far, far cry from being a collectors item or exotic (like vintage ones.) Talk to your lawyer and see what you can get for your pain and suffering, but don't hold your breath waiting for your new machine. There are car buying services out there that you can pay to find a car you specify, but they are going to have a hard time with the 350Z since most are flying out of dealers lots still. Plus your color pick is probably not the most widely ordered. I have nothing against it, just seems like CS and black are getting the most attention.

Medical payments can be collected double - from your insurance carrier and the person that hit you. This will not affect your rate and is legal but you have to file for it. Most people don't know about this so they don't bother. You can come out ahead of the game money wise this way. Send me a PM if you have questions and I'll ask my wife as she's in insurance.
As to your car I'd go the NNA as suggested and see if they can locate you a similar car for MSRP. Or just get an E:mail with your request to local dealers

GET A LAWYER NOW!

/I went through this with my Wife and her accedent a few years back... It took three years to get through. DO NOT WAIT FOR THE GUYS INSURANCE TO GET WITH YOU! They never will. Or they will try to fob you off with a min amount of money,,

1. You are the owner of a very collectable car.
2. You have had that prise winning vehicle removed from your possesion by the other guy.
3. You were hurt and possibly will have further pain and suffering in the future.

The lawyer will tell you that you can and will get compensated for it. You can get your cars cost plus extra ( over msrp ) so that you can replace the car. Plus you will be able to recieve more damages.. no due to your waiting forever to get the car.. but that goes into the suffering part.. but for everything else he can think of.

Make sure you explain the whole ordering , waiting, msrp and now unable to get such a low vin .. its like a loss of a collectors car... you can never get that low a vin on a first run car.

MAKE DAMN sure you get a lawyer that has handled this type of loss... Dont settle for just any lawyer....

Keep all the docs you can find for your car....

You should, but you won't be... If this thing gets to court eventually, then your insurance company might be willing to settle at best...

Same as above, your adjuster might be kind enough to consider this and give you some extra $$$ but I really doubt.

Get a lawyer. And I mean a lawyer that does it for a living and not someone from yellowpages. Make sure he's recommended by someone. Most lawyers don't know sh*t so get one that does.

While I don't know my VIN yet, I ordered almost the exact same car as you had just over a month ago. It's a W order number, and should be coming late December. It seems NISSAN is on the regular build schedule now, so if you can find a dealer w/allocation to spare [which isn't that hard] then you can have another in about 2 to 3 months.

I have a Lemans/burnt orange 6MT w/everything except the aero and splash guards, and I paid MSRP. I just went into the dealer, found they had allocation, and told them I would pay MSRP. They said OK.

Jeremy, get a lawyer, you need to protect your rights. I'm not an advocate of suing over every little thing, but in an injury accident like you had, you need to protect yourself incase anything happens from this in the long term.

As for the car, you also have the right to demand "substitution of vehicle" if they won't pay you enough. They would have to find a car for you, purchase it, and transfer the title to your finance company, or something to that effect. I heard Clark Howard talking about this just a couple weeks ago.

Sounds like Jeremy's gonna need it trucked down. I would ask if the dealer selling if they would be willing to deliver the car to a local dealer for nominal charge (cost preferred). Then I would definitely get a replacement right away. You can always reclaim the trucking expense in the lawsuit. Just a thought.

This looks like a tough decision. Don't know your insurance company. I personally have State Farm and they are breeze to work with.

However I also know that in cases such as yours (car is totaled) its best to hire and attorney you are dealing with lots more then 5-10K.

Regarding the car.

I have not bought the Z yet however sometime soon. But you can probably get your model for MSRP. Can't answer regarding the VIN. At this point I am uncertain what Nissan will do with the Z.

I didnt read the whole thing, but I have one item you might like to check out.

call gwinett place nissan. they had a lemans touring 6mt on the lot as of saterday for sale. they were asking 1000 over MSRP, but I got it for MSRP, and I bet with your story, you can too.

Im not certain what the options were, nav may not have been in there, but it is a car very close to what you wanted in GA. might be worth checking out. Id call quick, it may have sold already.

Thanks Vlad!! I think I will find one local. (Like that VIN though.)

I know Gwinnet has Z & J Pilot's car that he turned down, but I have heard a lot of bad things about them. I am going to Sutherlin Nissan. They are going to work with Nissan to get me a car. They have found one with everything I need except the Nav. If I tried to get the Nav from Nissan I would be looking at Feb of next year so I am going to have to get an aftermarket nav installed by the dealer.

I am getting a lawyer to deal with the insurance company. They want to know exactly what I paid and won't take into consideration the market value of the car that I may have to pay to replace it.

I will keep you posted.

Man you people are sick! yes he got in an accident. Yes a few cuts and bumps. But damn you are some DISHONEST people. They will give him retail value of the car. retail meaning whatever he has to pay for replacing it for a new one. I know this for a fact cuz i smashed my supra and got $8,000 more than i paid for it to replace it. But as for collecting double for medical and cheating people. not to mention thats the reason our insurance is so high CUZ of all you thieves out there! thats just plain messed up. They will pay ur medical bills, and pain and suffering. BE HAPPY YOUR ALIVE!!!!!!!
