Update poor red roadster damage
Back on Apr 11th, i was sitting at a stop light and some driver ran into the back of my z. Put in shop 11th of April, still do not have it back. As they removed the parts more damage was seen. They have to order some parts that could take 5 weeks to get. Damage is over 12,000 dollars and climbing. Rental car is only covered for a max of 400.00 dollars. Well past this. Could not have the car for another 2 to 3 weeks. The only rub is that we were sitting at a stop light, the other driver hit us and his insurance will not pay for the rest of the rental car charges.
Called his insurance agent and basically was told o well. Told his insurance company that I was going for dimished value. Car cannot be worth the same after it has been in the accident. Well I am still stuck with rental car charges in excess of 1500 dollars. Car is only 9 months old. Does not seem fair

That's why we have a court system - to sue people with weak or lame insurance! Keep your receipts and you're 110% certain to get every dime back from the lame insurance holder in small claims. Any injury suffered will be additional.

I would go through your own insurance company first and have them cover all the repair and rental costs (assuming you have rental coverage), and then let them deal with the other insurance company to get the money back. Initially, you may have to pay a deductible but you will get it back eventually since the accident was not your fault.
Alternatively, as others have mentioned, you could file a case in court, but it will likely take longer to get your money back, and you will incurr additional attorney costs.
In any case, keep track of all expenses that result from this accident, in case you do decide to go to court.

I agree with the guys above. You should be taken care of. Tell them you are getting an attorney. If they still don't budge, contact one. You shouldn't have to pay for anything. It wasn't your fault.

I was a claim specialist for a insurance company for 3 years. The guys insurance who hit you are just trying to "F" with you. Although I know taking them to court will take at least 2 years out of your life (yes they're slow with the process) it's still worth it in the end. And yes his insurance is liable for paying the rest of the rental fee's. If you want more info... PM me and I'll give you all the details...

Good advice from the adjusters above. I was an auto underwriter for an inurance company for a number of years, but I have a question for the adjusters: Minimum financial responsibility limits in MO and KS are 25/50/10. He stated that he has $12k in damage already. I was just curious if rental reimbursement falls into the property damage limit. Or does it have it's own sublimit?
I should propbably remember, but I wrote strictly commercial business and that's traditionally written on a combined single limit.
If the person who hit you had low limits, you may actually be out of luck. Unless they fight the accident and receive a negative judgement in court, the insurance companies are really only responsible for the limits on the policy.
