i feel bad for the next person to buy this z.. after u beat the **** out of it
I never said I beat the **** out of it I said I drove the **** out of it. You know, like put alot of miles on it. I could never beat the **** out of a Z. Its gonna go back to the dealer cleaner than I got it in fact.

If you can't afford the car, it just seems stupid for the dealer to make you commit to buying it. I would take it back and leave the keys at the dealership. Don't keep driving it and putting miles on it. Call the lender and tell them you volutarily turned the car back in.
If the dealer has any sense, they will just chaulk this one up. It's not like they won't have the car sold very soon anyway.
The more you drive it, the more risk of damaging it or having them accuse you of damaging the vehicle in some way.

Yeah thanks man. Since I learned of this issue I've been intent on getting the car back to them ASAP before something happens. I just drove the crap out of it the last week since I thought it was mine for good. Im just really bummed that now I have several dings on my credit.

To start off I'm truly sorry to hear that you have to return the Z ... You would have enjoyed much as anyone on this forum, Well for me this is my 2nd Z that I have purchased.
Ok back to your dealer problem ..... I have been working in the dealer for almost 5 years & more been there & could tell you all the things that happens to good people well as bad.
To me it seem like who ever was selling you the car wanted to get that car out before he even got funded for the deal that he made with your Z, Sorry to say this but with a spanking new credit as yours it extremely hard getting it financed. 1 you either got to have a positive co-signer or minimum 35% down payment.
The only reason they want you to pick up a different car from them is they don't want to lose money, you might sit there & think it's just couple buck they lose but yet again soon as a car come back to the dealer, they lose lot more then you think.
They do have the right to charge you for the miles & damages that has been made to the Z & I'm guessing that they will hit you pretty hard if you don't pick up another car from them but what can you do ?
Ok this is my point they should have never let that Z leave the lot to begin with, & to me seem like you deal was never funded with any type of banks (but go ask the dealer if your deal was funded ?) So basically they're ****ed in the a** if they don't find any type of bank to fund your deal & make sure you don't get that car damage with in any ways because they will hold you responsible & bang you in the head for $$$$$$.
So you will lose as well as the dealer ... so think of it as a win win lose lose case ..... and yes you have the right to return the car to the dealer because ... you might think it's you car right now but when the car's not funded from any bank it's still dealer's car not yours, So if I were you I go return it right about now.

Thanks for the advice. Ill go have it detailed before I bring it back so that They get it super clean. Im worried about them tacking on $ for the miles I put on it. What right do they have to charge me for the miles? Its not my fault that they led me to believe that my loan was legit, they are the ones that lied, not me. I dont think I should have to incur any costs.

Have you ever heard of a dealership taking on the loan that they pre approved? I heard that that was an option for dealerships in this case, a bad option for them but an option none the less. Thanks,

Fleshstorm don't even bother detailing the car before you even bring it back to the dealer, It one way or another either they're going to charge you for another detail or they might not knowing that you have the right to sue them. So keep your money in your pocket for another good deal on the Z.
Well the decision does not come from a sales person for you to take the car or not it all has to do with financing manager & the owner to say go for it in this case they both are retard to begin with, to me it's like renting the Z out to an stranger for a joy ride ?
You are right about them giving you a run around & you should not pay anything regard to mileage but you did enjoy the Z time being did you not ? I mean how much mile could you have put on the car 1000 + ? I don't think so well it shouldn't be more then .10 ~ .15 cent a mile so not a much of loss, But in the other hand you should straight tell the dealer how unnecessary this is really. If anything just call Nissan CORP & report them, If anything they'll tell you the best solution possible.
Next time your getting a car call or email the dealer & ask for the out the door price & if you see the number you were expecting ask for them to send you a credit app over the fax. Then if they get you 100% approved within they're financing team & everything is a go then go pick up the car rather then rushing in to everything within couple days.
One more thing with a brand new credit like your dealers are out to get more & more meaning they have more chances to rip off rather then a person with a 700+ score on they're credit, Even if you have 0 score your interest rate should not be more then 12 ~ 15% with decent amount of down payment.
If your on NOR CAL I'll be more then happy to send you to the person I got my Z from he'll really tell you what's up rather then giving you hopes not a Z.

Thanks alot for your time. I did enjoy it and if they want me to pay .15 cents a mile Ill probably just do it instead of starting a big hassle over it. It would be worth it to drive the car for that long at that price.

Now dont get me wrong Im not considering doing this, but on what grounds do I have the right to sue them? Because they are breaking the contract? I just know that it could help me get out of this mess if that is true and I let them know that I know that.

Sue for what??

The contract was contingent on being able to secure a loan. He couldn't secure a loan. Contract is void.

I'm in real estate. This happens every day. An offer to purchase is contingent on financing. If the buyer cabn't get financing, he gets his depsoit back, and the contract is void.

Why does everyone think a lawsuit is the solution to every problem?

Unless the agreement you signed included a clause that said there would be a miileage (or other) fee if you were unable to secure a loan, you owe them nothing.

So I had to return the car tonight. Im very sad, even more sad than I thought I would be. One of my main goals is to get back behind the wheel of one of these again. All of you guys have been alot of help through this and I want you all to know that I appreciate it alot. The transaction actually went really smoothly. It took about 3 min and I was done they didnt even look at the car before I signed the papers and handed them the keys. I could have destroyed it and they would have never known till it was too late. The car was parked in the far back of the dealership by the service area so I know nobody even laid eyes on it before they let me go, they didnt even check the milage.

Damn this sucks. Oh well I guess Ill go check the marketplace

Thanks for the follow-up. I am certain that it is difficult to drive a 350Z for a week then give it back. Keep in mind that cash always works: no one will ever asks for the car back if you pay cash. Never.

Yeah Im gonna start saving up and I should have enough dough to buy a used one by summer. It gets harder and harder everyday. But as soon as the snow is here Ill be 4wheeling all the time and wont be thinking about it as much. But right now while the weather is still good Im hating driving my 4Runner around.

You guys arent going to believe this. I just got a letter in the mail saying that I bounced a check, guess who the check is made out to? 10 e-points to the guy who gets who its made out to and what its for.

Close more specific.

The f*cks at the dealership tried to cash the check for my downpayment! I didnt have my funds transferred in that account so the check bounced. They were supposed to hold the check for 21 days after I bought the car, but decided to cash it way earlier. They cashed it 2 business days after I originally signed the contract, and before the loan was approved. If theres no loan theres no deal and they CANNOT cash that check!

When I took the car back I demanded for them to give me the check. The Manager goes to the vault, but returns to tell me that he cant access the vault till monday for some reason (when in actuality hes lying because the check isnt there). Upon realizing that arguing is getting me nowhere I settle on having them hand the check over to my buddy that works there and having him destroy it for me. Well no surprise but they never give him the check and dont even mention anything to him. So I check my account online and sure enough I find out why the check is MIA.

As a result my friend is quitting and Ill NEVER send anybody that I even remotely care about anywhere near this dealership.

Well they couldnt get that loan approved in the end so it cant be considered a realistic number.
