No, but I spent 30 minutes reading about it on the BBB web site.

Any mediator in their right mind would side with the consumer on this.. but we'll see.

The only thing I could possibly see go wrong is that the mediator would say "Well, there is a fix they have on they way, you are not allowing them to fix it".

That can easily be countered though.

BTW - what are you looking for? An '07 or just to get your moneyback and leave us in the Z world?

I still can't understand, with their level of engineering expertise in-house, how they can't have figured this out already, and that is what troubles me; that there is more here than meets the eye ........... ECU reprogram that reduces horsepower and causes "false advertising" issues, ECU reprogram that causes engine to "not pass" EPA guidlines, a fix that requires new engines with "all" 2006 6mt, and with their current financial state they want to avoid that, so they are stalling and hoping this only costs them a minimal amount, with new engines in the few who make a real stink.

I am trying to remain positive. I love this car other than this problem. I don't want to trade for an '07 and take a bath. I would like to enjoy this for a few years, build my equity, and when the new model comes out in '09 consider a trade then, if I like the new car enough.

Yeah, I would counter that the lemon law gives them 10 days and I've given them 9 months and they still haven't fixed it, not to mention waiting for an estimated date is ridiculuous for a car that I've already paid for. I'm usually pretty good in these situations but I gotta prep.

zphile, honestly, I'd let them replace it with an 07 with similar features and to pay to tint my windows again. I'd also like to be comp'd some shop labor hours for my trouble. Otherwise, they can cough up 15K cash and I'll agree to void my engine warranty and get a built and stroked motor.

Thanks man, I definitely will. Nissan will have to own up to this issue one way or another.

A straight up swap would be good enough for me. I was also thinking about what you said on the built engine.

I would tell them to pay for the built engine and an APS TT Extreme kit.

I'd still rather have the swap though since I feel even a built engine could have serious flaws since my belief is the engine is a defect in and of itself.

[EDIT] To heck with it. I would still need clutch and exhaust. Good idea though, but swap it!

In all likeliness they are not going to just cut a check for $15K and I wouldn't settle for any less. It's replacement, repurchase, or bust.

I would think Nissan would rather replace the vehicle if you financed through them (as I did). Then they would at least be getting the interest on the loan.

Yup, I'm through NNA too so that would be the most logical thing to do. If they repurchase they will take a larger hit by my calculations.

Not a chance!

When I went to get an oil change and wanted them to document how much I had lost, they had to call a technician over as opposed to the oil change people.

They just drain it, pay no attention to what was left. They actually probably start to drain it and walk away for a bit and come back when it is done.
