Does the Lemon Law apply to me at this point?

Default Does the Lemon Law apply to me at this point?

I am looking at getting another new engine. My first engine threw a rod at 50,000 miles, now the replacement engine, replaced under warranty, is burning a ridiculous amount of oil. Nissan is starting a consumption test next week on the new motor that only has 3,000 miles on it.
If they determine that I need a new motor, does this qualify for a lemon law or do I just let them keep putting new engines in the car?

I hate to sound like a retard, but I just assumed that they put a new 04 motor in.
I just tried to call the service dept., but they are closed for the weekend.

no lemon law does not apply car is too old, and no you didnt get a rev up just whatever motor your car originally had

I didn't know that they were having any consumption problems with the non-rev up.

Lemon laws differ from state to state. Looking at your profile, here's some info for you:

Section 1345.73
It shall be presumed that a reasonable number of attempts have been undertaken by the manufacturer, its dealer, or its authorized agent to conform a motor vehicle to any applicable express warranty if, during the period of one year following the date of original delivery or during the first eighteen thousand miles of operation, whichever is earlier, any of the following apply:

* Substantially the same nonconformity has been subject to repair three or more times and continues to exist;

* The vehicle is out of service by reason of repair for a cumulative total of thirty or more calendar days;

* There have been eight or more attempts to repair any nonconformity that substantially impairs the use and value of the motor vehicle to the consumer;


* There has been at least one attempt to repair a nonconformity that results in a condition that is likely to cause death or serious bodily injury if the vehicle is driven, and the nonconformity continues to exist.

lemon law is for new cars it doesnt cover a used car
