Rear struts on hatch questions

Rear struts on hatch questions
I searched this forum and all I find the fix to the hatch dropping on your head is to buy the new struts that other vendors are selling supposedly stronger and will hold the rear hatch. My question is that when I bought my 05 Z from the dealership, it already had the Nismo V1 kit all over (including the spoiler). The hatch seems to be dropping on my poor head every time when I am parked on a hill i.e. my driveway or sometimes it'll just start dropping on it's own while I'm digging through my trunk. The dealership says there is "nothing" they can do to fix it or replace it with a new set even though I think this is a health hazard and they should take more responsibilities making sure that "customers" aren't getting hurt or slammed in the head with the trunk hatch which is pretty heavy. What do you guys think? Should I fight the dealerships to have them replace the struts or is there any other fix besides to take the spoilers out?

if i were you i would purchase the ones the vendors sell they are 30% stronger than the stock ones and they will prevent your problem. they are slope and temperature dependent haha

there's actually a weight that's bolted on the hatch underneath the plastic cover. that hatch cover its just held on there by those plastic snap on things. once the cover is off you will see a black metal bracket with a somewhat rectangular block in the center. that's the weight.
i took mine off and i have see a nice improvement.
