Your legal requirement is for red lamps, not smoked. Probably would be cited.

In Tennessee your car must not have a visible light transmittance of less than thirty-five percent (35%).

so tinting your headlights is fine to an extent.

Check your local laws just in case, they might have changed it.
If you completely black them out, it is illegal. However, if they are still a very dark shade of red, it turns into a judgment call for the officer. Mine are done at 35% and I haven't had any trouble what-so-ever. I'd also recommend either using overlays, or buying a second set of tails so you could just swap them back to stock color to get your fix-it ticket signed off.
