Default Need some serious advice on faulty Nismo!!

My wife and I purchased our 07 Nismo 350z last August. 3 weeks after we drove it home it was in the shop for a clutch issue that caused it to stick to the floor. Since then, the car has been in the shop several times. Two more times for the clutch, which is still unresolved and other times for a very loud ticking noise in the dash that started when they replaced the hydraulics on the first clutch job. Now, the clutch is completely burnt out and the car is undriveable. (I told Nissan specifically that after the clutch would come back up, that you could smell burnt clutch for over an hour). Nissan of America is siding with this dealership in believing that this burnt out clutch is a result of normal wear and tear...This car has only 5000 MILES!!! So, they want me to authorize them to tear it down only if i agree to pay a total sum of 2500 big ones if they find me at fault, which theyve already convinced me that they will do what it takes to make sure it is. I know its not my driving ability with a stick shift. This is not my first stick by any means, but the lady at corp told me she sees alot of Z clutches burnt out at 5k. How is that? Wouldnt that indicate a faulty clutch? I would like your guys' opinion as seeing that my only other option ( that i know of) is to see a lawyer about it. Their incompetance in fixing my clutch issue is the result of its indriveability, not my driving skill. period. I really dont know what turn to take now. PLEASE HELP!!!

Oh yeah, the service manager believes its normal wear and tear (with the clutch) because the tires are showing some wear.

Would the clutch slip at all when you drove it? Sounds like they are trying to take you for a ride.

Default ******** indeed

The only thing the clutch did was completely depress itself upon shifting into second gear, sometimes third and finally sometimes in first. It might do it once a day or three times a day. Didnt really drive it much. The thick smell of clutch as a result hinted to me that maybe it was burning it up. But that kind of rationality flies over their (nissans) heads. Im at a dead end with them. And how does some tire wear indicate the condition of the clutch anyway? Doesnt make much sense to me but i do agree that they are trying to take us for a ride. Now what?

Lemon.
Go see a lawyer, or take it to a different dealership.

The samething happened with my Nismo, they even refused to cover my clutch master cylinder under the recall.I had my lawyer send them a letter, which they replied saying I had admitted to drifting the car[untrue]and they would not even mediate with me.I finally went to another dealer and had the clutch and master cylinder replaced at my expense.I made sure that I had the updated parts installed and have had no problems since. It boiled down to a dealership, who's service manager who claimed he was the eyes and ears of Nissan and thought a Nismo 350z shouldn't be driven hard and Nissan sided with him.As a result I will never buy another car from his dealership or Nissan again.I had planned to buy a GTR,but they can forget that.I get my service work done by another dealer and that dealer did the clutch for about half of what my original dealer quoted me.Good luck

Sorry to hear that. I had the same problem as you do. I also bought my Nismo back last August. It is highly likely that batch has bad slave cylinders. I took mine to the dealer when the clutch pedal first stuck to the floor and they said it was a faulty slave cylinder so they replace it. The same problem came back and the replace the master cylinder. After driving it 5 miles which is the distance between my house and the dealer the problem came back. I took the car back and it sat there for a week waiting for a Nissan rep to come check it out. Finally they replaced the entire transmission. I had no recurrence after that. All work was covered under warranty. I had only 1200 miles when i had my problem so they cannot say it is normal wear and tear.

contact NNA directly, if that gets nowhere, let them know you are going to file for lemon law, contact a lawyer

if they tried to fix the clutch three times and failed, you have a case I would assume. don't back down and be aggressive with them.

After a decision has been made NNA will back their dealer up and good luck finding an attorney that is willing to take on Nissan for a contingency fee.My best option was to pay $1100 at another dealer to replace the clutch, the car had already set for almost a month, now I have a dealer that will honor my still intact warranty.Nissan has much deeper pockets than I have and they would have contested any lemon law judgement claiming abuse and tie the car up for months or years.

I appreciate your opinions. I have contacted NNA and have received close to the same treatment from them as well, and yes, they are backing the dealer. I have appointments with 2 different lawyer firms this weekend but im not positive i hold all the cards. It seems that the law should be on my side. after all, with 3 attempts to repair and only 5k miles, how can they possibly entertain the thought that this is normal wear and tear. Im so pissed, its like i just lost all my faith in humanity. That is probably an exaggeration, but I feel like it is. Im getting f34ked!!! I have all my service records in hand, now I can only pray for good reception from the lawyer.

It seems there are alot of issues with clutch on the new nismo and it seems alot of you got shafted. I wonder if any of you would be interested in a class action lawsuit? I will know more about this possibility tommorrow, but i would like to know your thoughts on this as well. This entire situation seems unjust and unacceptable. Ive read about atleast 10 cars like mine. Not good.

i had the EXACT problem https://my350z.com/forum/texas/338996-clutch-sticking.html

which I posted here because no one in My area had the problem. I ended up putting a JWT clutch in my 06 but still havn't done anything about it in my Nismo. My husband has a Nismo as well and it happens to him from time to time, but i's like a big problem for me.
I feel your pain.

as pissed off as i would be... i just wouldnt waste my time and money to take it further with a lawyer. just not worth it. i'd just find figure it as a good excuse to get an aftermarket clutch and lightened flywheel and it should cost a helluva a lot less then the $2500 to get that done.

Nexx, you're right. That JWT made all the difference in the world. I'm just being lazy about doing it again. $5,000 on 2 jwt clutches within 1 year is excessive to me! Worth it.. but excessive.

well, although I respect all of your opinions, i think im going with the lawyer. The way that nissan has treated me and this whole situation has pissed me off to quite some extent. I really cant believe you guys would give up so easily and pay that kind of money to repair something that is defective.
