Default not feeling too good right now!

So I bought 4 "new" Nitto NT01's from "NIZMO0395" on March 11. I have quite a few track weekends on my old ones, so I was about to get my "new" tires mounted on Monday. Bottom line is they are far from new - they are 6 years old and, for track purposes, are completely useless.
Emailed the guy, but no reply as yet.

I was messing around with a tire durometer this morning and could not figure out why the Nittos I bought from you were reading a higher "hardness" level than my old ones which i am about to throw away.
Then I looked at the manufacture date on the tires.
The tires you sold me are REALLY old - they were manufactured in 2005!!!!!!!
Please contact me. I am hoping you did not intentionally misrepresent the item you were selling.

Were they sold as new, i.e. never mounted and driven on? Can you tell if they were mounted or driven on?

I suspect the seller, like 95% of the drivers in the world don't know that tires have a manuf date or that they have a shelf life.

Did seller say he recently bought them or were they "just lying around"?

How about a link to his F/S thread or at least the verbage of it.

Thanks for your questions and comments. I would NEVER post about any transaction on this forum without careful consideration and respect for the seller.
The "for sale" post disappeared immediately after I Paypal'd the funds. However, they were listed as new and never mounted. If I recall correctly, reason for the sale is that he had sold his Nismo.
The labels were still on the tires, so it is true they had never been mounted.
However, these tires definitely have a "history" which the seller did not disclose.

That BLOWS! I sold my stock Rays Nismo wheels & tires for this reason. I knew I had no use for them and I didn't want to see them sit. Figured someone should enjoy them before they expire.

Although if I had kept them my car wouldn't be sitting on a donut waiting for a new Volk and my other Volk to be refinished! ughhhh

Can you make a paypal claim?! If he indeed sold his nismo, he most likely doesn't surf this forum anymore. You would have to check and see what his last login date was for last activity.

I tried to make a Paypal claim this morning, but unfortunately, it is not possible. I am a day or two over the time limit. Also, I guess it does not fit neatly into any of Paypal's list of criteria for filing a dispute (I DID receive the goods and they WERE Nitto NT01's!).
He has posted VERY recently, maybe about a week ago.

what makes them useless? if they are not used, and produced in 2005, that does not mean they are useless

if they were stored properly (low moisture, preferably bagged), once heat cycled a few times, they should be perfectly fine for a typical driving event. I've used Hoosiers that were previously run, and new, that sat in storage for years at the shop, without incident. You already have them, might as well use them

I have no idea how these tires were stored. On casual inspection, they look like new.
Like I said above, I only realized something weird was going on when I took some "baseline" durometer readings which read extremely high, then I looked at the date of manufacture (I know I sound like a tire "nerd" but I'm really not!).
Now that I look closer, there may even be some early dry rot, (if you rub your finger around where the sidewall meets the tread, the rubber seems to crumble a little) although I am not certain about that.
I would certainly prefer to use them rather than just throw them away!!!!!!!
I'll have to decide pretty quick as I have a 3-day event coming up at VIR this month.

Well, that sounds reasonable. Of course, once I'm there, I'll have to use them for the whole 3 day event (I don't have another set of track wheels/tires).
And if I'm slow, at least I will have a credible excuse

On a broader note, I have to say that in my several years on this forum, this has been the only negative (and I know its not the worst thing in the world!)experience that I have had. There are so many awesome stand-up people in this community, its easy to assume that there are no exceptions.

Thanks to all (particularly Adam) for the advice.

I think you can get "old" new tires at the tire stores as well. If you happen to be buying a size that isn't sold very often, you could easily be getting tires that have been setting on the shelves for years. No one wants to throw away perfectly good tires just because they have "aged". I just sold my stock wheels and tires from my Z about 2 months ago. The tires probably had fewer than 2,000 miles on them but were almost 8 years old. I had no qualms about selling them and the guy that bought them hasn't complained. I'm not sure what the problem is..................

Actually, it was 2005, so maybe I have a "first edition" !!!!

Anyway, in fairness to the seller, he did email me today. Sounds like he is not in a great situation right now (no job, had to sell his cars etc), so I am just going to let it go.

Yeah no kidding!!! This guy was such a Freaking Troll, sorry to hear what happened to the OP. That really sucks and I know I would be mad but hope that you dont run into any problems if you do decide to put them on.
